The initial payment is to be $8,000 to cover the first two years of the lease. As in the previous agreement, a pro rata share would be reimbursed to the C ty if the City chose to terminate the lease of Tidelands Avenue and w uld be applied to the acquisition cost if the City determines to ac uire, either through negotiation or condemnation, the permanent align ent of Tidelands Avenue at any time during the leasehold period. In ad ition to the initial payment, the City had previously agreed to insta 1 a berm and to extend the existing fence to the right of way line. It is estimated that the cost for such construction would be appro imately $600. The revised lease is attached hereto. The C ty Council, commencing in fiscal year 1980-81, must appropriate neces ary funds for the payment of the rental for the upcoming annual lease old term. The C'ty Attorney has concluded a lease agreement with the property owner, DGMN, a copartnership, which provides for the lump sum payment of sa'd $20,000, the pro rata share of which would be reimbursed to the C'ty if the City chose to terminate the lease for Tidelands Avenue, and w uld be applied to the acquisiton cost if the City determines to acqui e, either through negotiation or condemnation, the permanent align ent of Tidelands Avenue at any time during the leasehold period.
