Th's was one of three contracts awarded for the budgeted project "S lar Heating, Parkway Pool." The contracts for the gymnasium li hting.and the roofing and sheet metal work have already been ac epted by the City Council. Gr at Western Solar Corporation has completed the solar system in ac ordance with the contract document except that the length of ti e to complete the work was longer than the ninety (90) consecutive ca endar days specified in the. contract. The work was to be completed by December 7, 1978. A final inspection and acceptance of the work wa made on February 14, 1979, by the Director of Building and Housing. In accordance with Section 3.04 of the contract, Great Western Solar Co poration agrees to pay liquidated damages in the amount of $50 for ea h day delay beyond the time prescribed to complete the work. Ho ever, in the contract it was further agreed that, in case the work ca led for under the contract is not finished and completed in all pa is and .requirements within the time specified, upon written request of the contractor, the City Council shall have the right to extend the ti e for completion. Gr at Western Solar Corporation has provided staff with sufficient ev'dence that they diligently attempted to complete their contract wi hin the time limit.
