In accordance with the emergency provisions of Section 1009 of the City Charter, City staff
contracted the services of West-Tech Contracting, Inc. (General Engineering Contractor License
No. 639767) for the repair of three storm drain facilities located at 882 Helix Avenue, 106 El
Capitan Drive, and 1188 Neptune Drive. The repair was completed on February 26,2010. An
fnfonnationalltem was submitted on April 21, 2009 (Attachment 1) with the plan to report back
to City Council after the full cost of the project was identified. This report represents the total
expendItures for the repair.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project falls
under the statutory exemption pursuant for Emergency Projects in accordance with Section
15269 of the State CEQA Guidelines. Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
fn February and March 2009, corrugated metal pipe (CMF) storm drain failures were discovered
at three locations in close proximity to residenl1al structures in the City of Chula Vista. These
failures occurred at: (1) 882 Helix Avenue, (2) 106 EI Capitan Drive, and (3) 1188 Neptune
Drive. Each of these CMP failures, if not repaired, posed imminent threats to public safety and
private property such as slope erosion and sinkholes. All of these emergency repairs needed to
be undertaken to protect life and property and were funded using Transnet Funds.
During regular storm drain maintenance, City crews discovered the failures. City crews
immediately televised the storm drain lines and City staff concluded that the pipes were severely
damaged and simply lining these would be inadequate as a repair strategy.
The Director of Public Works and the City Manager agreed with the recommendation of staff on
the necessity to proceed with the emergency repairs.
In accordance with City Charter Section 1009 and based upon the urgent necessity for the
preservation of life, health and property, City staff contracted the services of West-Tech
Contracting, Inc. to repair storm drain facilities for all of the three locations.
The approval of the resolution will accept the final report of expenditures in the amount of
$334,219.63 for the "Emergency Storm Drain Repairs at Helix Avenue, El Capitan Drive, and
East Emerson Street (DRI80B-C-E)" and ratify the actions of the City Manager and Director of
Public Works making and executing a contract for emergency repairs with West-Tech
Contracting, Inc. A breakdown of the total costs is provided under Fiscal Impact.
Contractor Selection Process
Staff prepareu and solicited three infonnal bids from qualified contractors that had previously
worked for the City of Chula Vista. On September 21, 2009 the City received three proposals.

DECISION MAKER CONFLICT
StatIhas reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the property, which are the subject action.
CURRENT FISCAL IMPACT
There is no impact to the General Fund as there are sufficient TransNet funds in the existing CIP
DR180 (approved by City Council under the FY 2009-10 Capital Improvement Program)
necessary to fund the project. A breakdown of the project costs is as follows:

Emergency Storm Drain Repairs at: (1) Helix Avenue, (2) El Capitan Drive,
(3) Neptune Drive, and (4) Grand Teton Drive
In Febmary and March 2009, cormgated metal pipe (CMF) storm drain failures were discovered
at three locations in close proximity to residential stmctures in the City of Chula Vista. These
failures occurred at (1) 882 Helix Avenue, (2) 106 El Capitan Drive, and (3) 1188 Neptune
Drive. Each of these CMF failures, if not repaired, poses an imminent threat to public safety and
private property. In addition, staff was made aware of a 7-ft by 7-ft by 10-ft deep sinkhole on
Thursday, February 19, 2009 that had developed at 1526 Grand Teton Court, as reported in a
Febmary 23, 2009 Information Item to City Council, due to the displacement of concrete storm
drain pipe segments. All of these emergency repairs must be undertaken to protect life and
property and are being funded using General Fund Reserves.
Due to heightened awareness of significant cOffilgated metal pipe (CMF) failures throughout San
Diego County in 2004 and 2005, on March 22, 2005, the City contracted with Hirsch &
Company Consulting Engineers to evaluate the existing condition of the approximately 88,000
lineal feet of cormgated metal pipe (CMP) storm drain within the city limits. In November 2005,
Hirsch & Company delivered a prioritized CMF repair report listing all inspected CMPs, with
the associated recommended priority and recommended timing for the rehabilitation of each pipe
segment. Due to the conditions of the inspected pipes and the projected rates of deterioration of
these pipes, the consultant recommended that all pipes be replaced or structurally lined within
one to five years of the report's submittal.
The November 2005 Hirsch report prioritizeu all CMP repair work as followed:

Much of the approximately 2,282 lineal feet of existing CMP identified as "Priority 1" has been
rehabilitated, largely due to funding provided to the City through the Federal Department of
Housing and Urban Development. However, none of the CMP under Priorities 2, 3 and 4,
totaling approximately 33,993 lineal feet, has been addressed, due to budget constraints and the
lack of dedicated funding for CMP rehabilitation and drainage projects. As a result, CMPs in
Priorities 2, 3, and 4 are currently rehabilitated on an emergency basis only as failures occur,
which is costly and inefficient compared to performing rehabilitation on a prescribed priority
schedule. Further, without a dedicated funding source to rehabilitate these pipes and with the
passage of time, the rates of deterioration and failure will increase into the foreseeable future.
Each of the current storm drain repairs are being performed on an emergency basis in accordance
with provisions in Section 1009 of the City Charter. Public Works staff has taken precautionary
measures where deemed necessary to provide protection and safety in the interim, until
permanent repairs may be implemented.
An emergency contract has been let to Cass Constmction Company for the repair of the concrete
storm drain system and embankment at 1526 Grand Teton Court. This work is currently
underway.
FISCAL IMPACT
There are no direct or dedicated funding sources for the maintenance and repair of storm drain
facilities; therefore, General Fund Reserves are used to fund this type of work, but only on an
emergency basis. Staff will return with an item on May 12 for appropriation of funds.
Emergency repair costs will be presented to City Council upon completion of emergency work.

WHEREAS, these failures occurred at: (1) 882 Helix Avenue, (2) 106 EI Capitan
Drive, and (3) 1188 Neptune Drive; and
WHEREAS, each of these CMP failures, if not repaired, posed imminent threats
to public safety and private property such as slope erosion and sinlcholes. All of these
emergency repairs needed to be undertaken to protect life and property; and
WHEREAS, in accordance with City Charter Section 1009 and based upon the
urgent necessity for the preservation of life, health and property, City staff contracted the
services of West-Tech Contracting, Inc. to repair storm drain facilities for all of the three
locations; and
WHEREAS, the repairs were completed on February 26, 2010. An Informational
Item was submitted on April 21, 2009 (Attachment 1) with the plan to report back to City

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
Chula Vista does hereby accept the final report of expenditures for the "Emergency
Storm Drain Repairs at Helix Avenue, El Capitan Drive, and East Emerson Street
(DRI80B-C-E)" and ratify the actions of the City Manager and Director of Public Works
