ITEM ~ITLE: Resolution ~91i0 Accepting, dedicating and naming real
property for public right of way, Third Avenue

The ouncil in their 1979-80 budget approved the widening of Third
Aven e between "G" Street and "K" Street which is a federally funded
F.A. project. Engineering has acquired five minor parcels of right
of w y for construction of sidewalks at five curb returns. It is my
RECO. MENDATION: That Council adopt resolution accepting real property,
dedi ating for public use and naming as Third Avenue.

DISCUSSION:
The ngineering Department prepared an appraisal for five properties
alon Third Avenue for the purpose of acquiring corner segments for
cons ruction of sidewalk in the curb return areas for the widening of
Thir Avenue between "G" Street and "K" Street. The area of each parcel
is a proximately 50 square feet.
The parcels are identified as follows:
Parce l One - 451 Third Avenue, Kentucky Fried Chicken,
N,E. Corner of Alvarado Street
Parce l Two -- 473 Third Avenue, St. Rose of Lima
S. En Corner of Alvarado Street
Parce l Three - 745 Third Avenue, Beauty Salon,
N.E. Corner of Kearney Street
Parce Four - 753 Third Avenue, Stop and Go Drive Thru,
S,E, Corner of Kearney Street
Parce Five - 49~ Third Avenue, Heavenly Donuts,
N.W. Corner of "H" Street
Neg of ations for the acquisi~~ion of right of way was performed by Ken
Goldk mp, Senior Civil Engineer, and Tom Harron, Assistant City
Attor ey. All parcels were purchased at the appraised value except for
the p rcel at Third Avenue and "H" Street which was purchased at a cost
of $1 5 above the appraised value. In the judgment of Mr. Harron the
negot ated purchase price (settlement) was reasonable in lieu of the
cost o the City for filing eminent domain proceedings. All right of
way w s acquired in accordance with federal guidelines and procedures
requi ed for receiving F.A.U. funds.
