A re~uest has been submitted by CEP Associated, acting as agent for The
Gersken Companies, to quitclaim a 2--foot portion of the 20-foot wide
drainage and pedestrian easement on Lot 257 of El Rancho del Rey Unit
No . ~ .
RECOMMENDATION: That Council.
1. Adopt resolution quitclaiming subject portion of Ci.ty's
pedestrian and drainage eas~ament.
DISC~JSSION:
Due ~o a conflict in the different widths of the easement as shown on
the ubdivision Map, the grading plains and the plot plan, the house was
constructed 18 feet from the property line, 2 feet inside the easement.
It i~ the opinion of the City Attorney that vacation of this ?_--foot
stri~ is not necessary and that execution of a quitclaim deed is all
that ~~, is needed .
The storm drain is located S feet from the lot line and therefore 13
feet',, from the house. Also, there is ample space for the pedestrian
easement.
The developer is also requesi.ing a quitclaim deed for the subject 2-foot
stri~ from Otay Municipal Water District. An easement over the same
property was dedicated to Otay N~.unicipal Water District for a water
main;
I hake no objection to quitclaiming subject portion of the easement.
A transparency is available f~, Council viewing.
