Windmill Farms, lessee of the Safeway property at 435 Third Avenue, recently requested a deferral of the requirement to underground the existing overhead electrical service as required by the Chula Vista Municipal Code in conjunction with the issuance of a building permit to rem ad el the existing building . RECCDMMENDATION: That Council: 1. Hold a public hearing as required by Section 15.32.070. 2. Approve the request for deferral of undergrounding requirements. BOARD/COMMISSION RECOMMEN!~.ATION: Not applicable. DISCUSSION: Recently, Windmill Farms applied for a building permit to remodel the exiting Safeway Store at 435 Third Avenue. The valuation of the work exceeded 520,000.00. According to Chapter 15.32 of the Municipal Code this improvement constitutes a requirement to place the existing overhead utility services underground. Windmill Farms explained that the cost of conversion would be an unnecessary burden at this time and that it would be more practical to convert at the time an overall undergrounding district is formed. The electric meters are presently on distribution panels along an interior wall. Upon converting to underground service, San Dieg o Gas & Electric Co. requires either: 1. Relocating the meters to the outside of the east wall or; 2. Constructing a meter room dire~'.-1y accessible from the exterior. This information was verified by :a representative of San Diego Gas & Electric Co. ~a~ ~ ~ Form A-113 (Rev. 11/79) ~"6-~6G,t,'' ~.- ~- S'O Page 2, Item No. 7, 7a Meeting Date 2-5-80 If the meters were to be placed on the outside of the building along withthe necessary panels, it would not improve the appearance as comp~red to the existing overhead services. Aesthetically, we believe it would be an even "trade off". In o~der to provide a meter room within the building, several items must be considered 1. I~~Due to the configuration of the refrigerator rooms along the east 'wall, the only location for a meter room is on the northerly end of 'the building . 2. ~I To underground at that point, one gas meter and two water meters ;would have to be relocated. 3. 'Access to the exterior of the building would have to be provided for the San Diego Gas & Electric Co. meter readers. The estimated cost of this work is approximately $7,000.00. Windmill Farms is leasing the building and has expended a substantial amount of money to upgrade the appearance of the building. I believe that the additional cost caould be an extraordinary burden in this case. In accordance with Section 15.32.070, I find that enforcement of the requirements in this subsection would result in unnecessary hardship to the lessee and that this deferral will not be detrimental to the health, safety or general welfare of the neighborhood.
