The City Council on October 9, 1979, by Resolution 9798
awarded to Aaley Corporation the contract for the City's
project, Street Overlay Program 1979-1980. The contract
time expired on January 11, 1980. The contractor is
requesting an extension of time to February 1, 1980.
Based upon estimated quantities and the unit price bid for
asphaltic concrete, the City Council at time of award
deleted the paving of Landis Avenue north of "E" Street to
bring the construction cost within the amount of budgeted
funds for the project.
When the contractor completed the overlay of the streets on
November 27, 1979, it became evident that it took less
asphaltic concrete to overlay the streets and that there was
enough asphaltic concrete left over in ttie contract to pave
Landis Avenue .
At the request of the Cityr a change order was executed to
add back into the contract the paving of Landis Avenue. The
contractor agreed to the change order provided he could
schedule the paving of Landis Avenue with other work which
met City specifications. This is because the contractor's
plant has to be set up to make the asphaltic, concrete to
City specifications and the amount of material required to
pave Landis Avenue is such a small quantity --- 175 tons.

This work was scheduled once in December and rescheduled to
be completed on January 11, 1980. Inclement weather forced
a delay and Landis Avenue was rescheduled for January 15,
1980. Again rain has required the cancellation of work.
Because of the uncertainty of the weather and the scheduling
of other obligations, Daley Corporation has requested an
extension of the contract time to February 1, 1930.
