On December 13, 1979, the Civil Service Commission studied the advisability of waiving
certain rule requirements for the implementation phase of the recommendations made by
Arthur Young & Company. Briefly, the recommendations are: (1) to allow incumbents in
positions which have been upgraded to assume incumbency in the new classification without
going through a competitive examination, and (2) to allow incumbents filling positions
which have been downgraded to retain the rate of pay they were making at the time the
downgrade is affected. The Commission felt that the approval of these two recommenda-
tions would protect employees from potential losses which could occur when the study
was implemented. They felt this protection was appropriate in that the effect on
classifications would have been the result of changes in position duties and would be
no fault of the employee whose position was affected.
The reasoning behind the two recommendations follows:
Recommendation Number 1 - Eliminate the need for competitive .examinations when positions
are upgraded.
The City's normal procedure for filling a reclassified position is to require the
incumbent to compete for the higher level position. This practice is a sound one
for ordinary classification work, because the change in classification frequently
has been due to a reorganization or new position rather than a gradual change over
time in job duties. Enforcing the requirement for competitive testing during a
City-wide restudying of positions, however, could. create an impossible testing
burden for the Personnel Department and might also result in the untenable situation
of an incumbent not scoring high enough on the examination to keep the job which he
or she has been doing. Therefore, it would be to the advantage of the City to waive
the requirement for competitive testing for reclassifications which result from the

Recommendation Number 2 - Adopt use of the "Y" rate for incumbents whose positions
have been downgraded.
The maintenance of a higher salary after a position is downgraded is called "Y"
rating and is covered in Civil Service Rule 1.02 A.5. The use of the Y rate is
being proposed to alleviate the fears of employees that the survey might result
in a pay cut for them. It also recognizes the fact that if a position is now a
lower classification than it once was, this is no fault of the employee. Instead,
City organizational structure and/or supervision has given to that position
different duties than once were assigned. For these reasons the blanket use of
the Y rate provision in implementing the recommendations of the Arthur Young &
Company study is recommended.
