DISCUSSION:
• In order to provide water service to the "H" Street entry median, the
installation of a 1-1 /2" service sleeve and irrigation line under the MTDB
tracks at "H" Street is required. This area lies within MTDB easement
property and a Right to Enter permit is necessary. An application for the
permit has been filed and reviewed by San Diego and Arizona Eastern Railroad.
Approval by the SD&AE Board of Directors was received on April 8, 1988.
In order to provide future maintenance to the sleeve and irrigation line, an
easement from MTDB and/or SD&AE is also necessary. Pending receipt of a legal
description of the property, this easement will be granted. The Engineering
Department is currently working with the Planning Department in preparing this
description.

Both the permit and easement is a common procedure followed by any agency
wishing to work within MTDB right-of-way. The City currently has similar
permits on file. The City Attorney has reviewed and concurs with staff's
recommendation.
FISCAL IMPACT: The City is required to provide $1 million liability
insurance for the Right-to-Enter Permit. This requirement has been reviewed
by the City's Risk Manager and found acceptable.
