HomeMy WebLinkAboutReso 1989-15284 RESOLUTION NO. 15284 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING THE DIRECTOR OF PUBLIC SAFETY TO SIGN THE SAN DIEGO COUNTY ANIMAL CONTROL MUTUAL AID AGREEMENT The City Council Of the City of Chula Vista does hereby resolve as follows: WHEREAS, no formal mutual aid agreement between the animal control agencies in the county currently exists, and WHEREAS, each agency has informally provided assistance to others, and WHEREAS, a formal mutual aid policy between all animal control agencies in the county in the event of an emergency or disaster is being established, and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby authorize the Director of Public Safety to sign the San Diego County Animal Control Mutual Aid Agreement on behalf of the City of Chula Vista. ~resented by Approved as to form by fl~ t T J n, City Attorney 6144a Resolution 15284 PASSED, APPROVED, and ADOPTED by the City Council of the City of Chula Vista, California, this 5th day of September, 1989 by the following vote: AYES: Councilmembers: Malcolm, McCandliss, Moore, Nader, Cox NOES: Counci 1 members: None ABSENT: Councilmembers: None ABSTAIN: Councilmembers: None ' Gr R. AutheTet, City C rk SAN DIEGO COUNTY ANIMAL CONTROL MUTUAL AID AGREEMENT This agreement made and entered into by and between the County of San Diego Department of Animal Control and the animal control agencies within the County of San Diego, shall be known as= "THE SAN DIEGO COUNTY ANIMAL CONTROL MUTUAL AID AGREEMENT". Nothing in this Agroement is intended to lessen participating members authority over, and responsibility form events occurring within their Jurisdiction. w I T N E S SET H: WHEREAS, it is desirable that all the resources and facilities of the County of San Diego Department of Animal Control and the animal control agencle~ within the County of San Diego be made available to prevent and respond to disasters ~:jich may resutt from such calamities as flood, fi~e,. eart,%quake, pestilence, riot, and hazardous material Incident; and WIIEREAS, it tS desicable that each of the parties he~uto !' should voluntarily aid and assist each othe~ in the event 8n emergency o~ disaster, by the interchange oE seevices, facilities0 End ~esources, ~nclu~lng~ but not limited ~"'~ comm~nica~lon, t~anspo~tation, and kennel services, to cope ~ith problems of =escue~ evacuation and shelter of animals; an~ WItEREAS, it is necessary and desirable that a cooperative agreement be executed for the interchange of such mutual aid on'a local and countywide basis} and ~HERE~S# there exists a Joint Powers ~gEeement amon~ and between the County Of San Diego and the incorporated CIties ~ithin the County~ that establishes the Unified San Diego County Emergency Organization~ hereinafter referred to as the Unified Emergency O=ganization~ and · ~' WliEREAS~ such Unified Emergency Organization is :"" responsible for ~eg!.onal emergency preparedness in the San Diego County Operational Area; NOk' THEREFORE, in consideration ok the mutual covenants contained herein, the parties heteto do hereby mutually agree tO the following= .:,, ':? ,~ ~ '~ ~'~ ,~. :: , '~ ' , -2- 1. Each party agrees to furnish resources, facilities and servic,l.~ to each and every other party to this agreement to prevent, respond to, and recover from an emergency or disaster, and te detail the method and manner by which such resources, facilities, and services are to be made available and furnished. However, no party shall be required to deplete its own resources, ~f~Cilities, and services unreasonably in furnishing such mutual.aid. 2. It is expresal~ understood that this agreement and the Animal Control Annex, Annex O of the Sen Diego County Emergency Plan, shall not supplant existing mutual aid or contractual agreements between any parties~ It is further understood that the mutual aid extended under this agreement and under Annex O shall be without reimbursement, unless otherwise expressly provided for by the parties to this agreement; and that such mutual aid is intended to be available in the event of an emergency or disaster of such magnitude that it is, or is likely to be, beyond the control of a single party and requires the combined forces of several or all of the parties to this agreement. 3. 2t is expressly understood that any mutual aid extended under this ~'r~,nent and under Annex O is furnished in accordance with ~.he "California Disaster Act" and other applicab]e.provllionl of law. Zt is further understood that except°as otherwise provided by law, the responsible local .. ~.='~i 7, :' ' -3- official in whose 'Jurisdiction en incident requiring mutual aid has occurred shall remain in charge at such incident including the'direction of such personnel and equipment provided him or her through the operation of such mutual aid plans. 4. Each party agrees to develop its own internal plan providing for the eK['ective mobilization of all animal control resources a~d Kacilities under its control, both public and private,~to{~pe with any type of disaster. 5. This agreement shall become eKrective as to each party upon approval and execution by that party's governing body, and shall remain in eKecot and operational between each and every party, unless participation ,is terminated as speciKied below. , The termination by one or more of the parties oK this agreement. shall not aKrect the operation of this agreement between the other parties thereto. 6. Upon approval by thejBoard ~K Supervisors~ a cartiKied copy of the executed agkeement shall be Kiled with the Unilled Emergency Organization. . b. The City Council, Governing Body, or authorized official shall execute this agreement on behalf of the participating Cities, and other public or private agencies. Upon approval, a certified copyof the exacuted agreement shall be filed with the Unified Emergency Organization. c. Any public or private agency which regularly enforces State or local animal related laws or ordinances may become a party to this agreement by executing an agreement hereunder/and filing such executed agreement with the Unified Emergency organization. 7~ Uponlapproval or execution of this agreement, or amendment thereof, the Unified Emergency Organization shall send copies to all participating agencies. The Unified Emergency Organization shall keep all parties advised of active participants to this agreesent. r S.~ The county~ Cities, and other public and private organizations, who ~re partners in this agreement, may terminate participation by resolution, and by giving written notice to all other partie~j'~A~oertified copy of such'resolution shall filed with the Unified Emergency Organization, and said termination shall be effective 30 days after receipt of such resolution. 9. Each and every party to this agreement agrees to indemnify and save all other parties, Jointly or individually, to this agzeamen~ and their respective agents and employees harmless ~.frbm any and a111iability, claims, damages or injuries to any person# including injury to any of one or more party's employees and all claims which arise from or are connected with such parcy'e performance or failure to pe~=~orm the obligations of this agreement, or are caused or claimed to be caused by the acts of such party~ or its a~9nts or employees, and all erpenses of Anveetigating and defending against same.
