HomeMy WebLinkAboutAgenda Statement 1988/06/21 Item 21• COUNCIL AGENDA STATEMENT Item 21 Meeting Date 6/21/88 ITEM TITLE: Resolution ~3 ~3 8 - Finding Compensation of Unrepresented City Employees Unfixed and Uncertain SUBMITTED BY: Assistant City Manager REVIEWED BY: City Manager 4/5ths Vote: Yes No X Constitutional constraints surrounding the City's ability to alter compensation of its employees after service has been rendered requires the City Council to adopt the attached resolution making the finding that compensation for unrepresented City officers and employees is "unfixed and uncertain" on and after July 1, 1988. RECOMMENDATION: Adopt resolution. OARDS/COMMISSIONS RECOMMENDATION: N.A. SCUSSION: Negotiations with the Western Council of Engineers may not be completed prior to the beginning of the next fiscal year. The compensation of employees represented by WCE becomes "unfixed and uncertain" as a matter of law upon the expiration of their current MOU (June 30, 1988) since they are engaged in negotiations for a successor agreement. This means that retroactivity of salary and benefits for WCE is a negotiable issue. In the case of unrepresented employees or officers (including department heads and middle managers), constitutional constraints would not allow for retroactive adjustments to compensation of unrepresented employees or officers unless a declaration and finding by the City Council is made that such compensation is "unfixed and uncertain" Adoption of the resolution does not automatically provide for retroactivity for unrepresented employees but provides a mechanism whereby the City Council can legally make that determination after the start of FY 1988-89.
