RECOMMENDATION: That Council adopt the subject resolution, authorize the Mayor to sign the agreement on behalf of the City and direct the City Clerk to have the resolution and agreement recorded. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable DISCUSSION: Rancho del Rey Partnership, developers of the land adjacent to East "H" Street are in the process of widening the road from Terra Nova to Buena Vista Way. The widening on the north side is nearly complete. Upon completion, of the north side, the south side widening will immediately commence. The developers would like to stockpile the excavated material from the necessary cut slopes on their property to facilitate widening of the south side. The developers' engineer estimates the amount of fill to be approximately 6000 cubic yards. The fill is proposed to be placed in a vacant area on the south side of East "H" Street, ,just west of Paseo Ranchero. The fill deposited shall be designated as an uncontrolled embankment and constructed per the approved plan ar~d permit. 2. The developer acknowledges that the site is not eligible for a building permit. 3. The site work shall be done and maintained in a safe and sanitary manner at the cost of the owner or his successors in interest. The owners have executed their portion of the agreement and the grading plan has been approved by this department. ~AL IMPACT: None JWH • ~ ~~ ~-~ .~ f
