Agreement with John & Teresa Imgson and Jo Ann Phillips at
224 Palm Avenue

Mr. and Mrs. John Impso//n have requested that the City amend the
agreement in which they allowed the City to place a lien on their
property in lieu of posting a cash bond to guarantee the deferral
of public improvements along their property at 224 Palm Avenue.
Since the agreement was part of Council Resolution No. 13049, the
Council must approve any amendment to that agreement.
Recommendation: That Council adopt a resolution approving the
subject amendment and direct the City Clerk to
forward the amendment to the County Recorder.

Discussion: Approximately a year ago, John & Teresa Impson and Jo
Ann Phillips applied for a deferral of the requirement to install
public improvements along the frontage of their property at 224
Palm Avenue. The request was granted by the City Engineer. The
owners then requested that they be allowed to enter into a lien
agreement with the City to guarantee the future construction of
said improvements in lieu of posting a cash bond. At its meeting
on June 2, 1987, Council adopted Resolution No. 13049 approving the

is lifted from that property. They have requested an amendment to
the lien agreement in which the lien is lifted on Parcel 1, but is
left on Parcels 2, 3 and 4 (Assessors Parcel Nos. 624-G54-90, -91

34,580 square feet, or 0.8 acres. The amount of the lien is
$11,333.00. According to the County Assessors
records the assessed valuation of the property before subdividing
(including improvements on the land) was $99,739•
Staff feels that the Impsons request is reasonable and that the
amendment to the agreement will not jeopardize the City's ability
to have the deferred improvements constructed at a later date.
