McMillin and Chula Vista City Attorney (4/5ths Vote: Yes No X ) The proposed Settlement Agreement would result in the dismissal of the Hyatt's inverse condemnation case against the City of Chula Vista. RECOMMENDATION: Adopt the Resolution BOARDS/COMMISSIONS RECOMr~NDATION: N/A DISCUSSION: On November 24, 1987, the Hyatts filed a complaint against the City of Chula Vista and Bonita Long Canyon Properties claiming inverse condemnation of their property. The Hyatts were concerned about a proposed drainage improvement that bordered on their property. Negotiations have been going on for some time between the developer and the Hyatts, but the negotiations had not been • consummated and the Hyatts were being careful to preserve their rights. McMillin and the Hyatts have now reached agreement on compensation. Bonita Long Canyon will be paying the Hyatts a total of 18,000 and the land involved in the drainage system will be dedicated to the City in fee. It's my recommendation that we approve the Settlement Agreement which will result in the dismissal of the inverse condemnation lawsuit against the City.
