Council closed the public hearing and directed staff to negotiate with any interested property owners and bring back a resolution for vacation. Staff did negotiate with the adjoining property owner, Mr. William Perkins (no other interest was shown), and submitted a report on April 12, 1988, including the terms of the sale of the excess right-of-way. RECOMMENDATION: That Council approve the resolution waiving the procedural • requirement for the sale of surplus right-of-way and adopt resolution conditionally vacating the street subject to conditions and deeding the excess right-of-way to Mr. William Perkins. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Street Vacation As discussed in the report of November 3, 1987 (attached), a traffic study was conducted to determine the impacts of closing the street. The study found that approximately half of the 2,000 daily southbound trips on this segment of Silvas Street continue south of Anita. Due to the tight distances between Silvas Street and Broadway, the move for southbound Broadway to turn right and then left on Silva Street should be discouraged. By vacating the subject right-of-way, all vehicles would continue southerly on Broadway and turn right at Main Street. There is, however, a condition of vacation that the property owner install a 45' radius curb return between Broadway and Anita so that vehicles entering Silvas Street, will be able to make the turn in a more facilitating manner. Based on the findings in the traffic study and the evidence submitted the subject portion of the street recommended for vacation is unnecessary for present or prospective public use. ~. • • Page 2, Item 7a, ~ Meeting Date 0 88 Sale of Excess Right-of-Way As discussed in report of April 1?_, 1988 (attached), staff has negotiated with the adjoining property owner for the sale of the right-of-way. The proposed agreement provides the following terms and conditions for the sale of the right-of-way: 1. The sale price is based on $4.25 per square foot which calculated to a total value of $39,911.75. 2. The City will share half of the cost of the traffic study and appraisal property in the amount of $2,400.00 ($4,800.00 total) which will be subtracted from the sales price. 3. A site plan is to be submitted and approved by the Design Review Committee showing how the vacated land is to be used. One of the conditions of the sale was that there would be no structures proposed in this excess right- of-way that would block the view of the property to the south of Anita. The purpose of the site plan is to support this condition. 4. A complete set of improvement plans for the reconstruction of the Broadway and Anita Street improvements shall be prepared by the applicant's private engineer and the plans approved by the City Engineer. 5. Permits, bonds and agreements shall be submitted for the work in the public right-of-way. As a condition of this sale, the applicant agrees to pay for all the public improvements and work necessary to complete the public improvements. 6. A parcel map or adjustment plat shall be prepared by the developer to include the entire vacation as part of the developed lot. FISCAL IMPACT: This will result in revenue to the City of Chula Vista in the amount of $37,511.75.
