On June 23, 1987 Council approved the Tentative Subdivision Map for Rancho Del
Sur. However, several conditions of approval were added or modified by
Council at that time. One of those added/modified conditions involved a
traffic signal at the southbound off-ramp of I-805 and Telegraph Canyon Road.
During discussions with the developer and representatives of the California
Department of Transportation (CalTrans), it has been determined that the
signal condition cannot be complied with in the manner required under the
added condition. Therefore, the developers have requested an amendment
that would assure the signal but allow them to proceed.
• RECOMMENDATION: That Council approve the resolution amending condition 31
of Resolution 13111 to allow the portion of condition 31 dealing with traffic
signals to be satisfied by the posting of a cash deposit rather than
completion of the improvement.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
In accordance with the direction of Council as expressed in the referenced
Conditions of Approval the developers of Rancho Del Sur contacted CalTrans
with regard to completion of the required work.
In a meeting on February 16, 1988 among CalTrans, the developer and City
representatives we were advised that CalTrans would issue permits for turn
lanes as required by Condition 5.
However, CalTrans would require that the installation of traffic signals at
the intersection of the southbound off-ramp with Telegraph Canyon Road be done
as part of a larger project to avoid construction of an "incremental"
project. That larger project would include widening of at least the
southbound ramp and additional work in Telegraph Canyon Road. Information
developed in conjunction with the amendment of our General Plan may also
indicate that the ramps may need to be relocated.

This larger scale work could also be eligible for funding by the state when
funds become available. That determination would be made at a later time.
The estimated cost of traffic signals as provided in Condition 30 is
approximately $60,000 to $70,000. The cost of additional ramp widening work
seen by CalTrans to be ultimately necessary is approximately $250,000 to
$275,000.
Section 66462.5 of the Subdivision Map Act prohibits the denial of a final map
because of off-site improvements requirements on land not belonging to the
subdivision or local agency. Normally, the City Council could condemn for the
needed right-of-way. However, in this case, if Cal Trans refuses to allow the
work to proceed within their right-of-way and the City Council cannot condemn,
the requirement to do any work at all would disappear unless modified as
suggested by staff and agreed to by the developer.
The cost of the signal work originally required by Council represents a
relatively small portion of the cost of the overall work anticipated by
Cal Trans. Because of this disparity it is our opinion that Condition 31
should be amended to require that a cash deposit of $70,000 be made prior to
approval of the Final Map for Unit 1 of Rancho Del Sur.
This amendment should be approved prior to the approval of the Final Map to
• keep the conditions clear.
FISCAL IMPACT: The cost of all work under conditions 31 is subject to
reimbursement from payments into a facilities benefit assessment district. In
that instance no fiscal impact would be realized from this project.

RE: RANCHO DEL SUR I-805/TELEGRAPH CANYON ROAD INTERCHANGE
IMPROVEMENTS
Dear Tom:
• Thank you for your assistance at our 2/16/88 meeting with Cal-
Trans. At that meeting we attempted to clarify their positions
regarding the proposed I-805/Telegraph Canyon Road Interchange
Improvements required pursuant to Conditions 5 and 30 of our
Tentative Subdivision Map, Resolution No. 13111.
As you are aware we have been working with Cal-Trans for
approximately 8 months attempting to resolve all issues. Cal-
Trans is concerned that the current revisions are incremental in
nature, and their policy is generally not to approve "incremental
revisions". They would prefer to make all the necessary
revisions once the updated traffic generation information is
available based on the new General Plan Amendment for the Eastern
Territories.
Cal-Trans stated at the 2/16/88 meeting that they would be
willing to process individual encroachment permits for the work
required by Conditions 5 (Eastern side) and 30 (Western side) to
allow the work to proceed. However, they stated that they would
not allow the installation of a new traffic signal at the
intersection of the southbound off ramp and "L" Street (Condition
30) without the widening of the ramp and additional improvement
on Telegraph Canyon Road. The estimated cost of the new signal
is approximately $60,000 to $70,000 and the cost of all the items
Cal-Trans additionally desires would be between $250,000 and
$275,000. This additional work was neither contemplated nor
• required in Condition 30 of our approval.

As you pointed out during the meeting Cal-Trans is requesting
that we correct a current problem area that is being impacted by
our Project only to a very small degree. Cal-Trans agrees that
this type of improvement could be potentially funded by state
funds as they become available. They also believe that this work
should not be done until the new project study report is prepared
based on the new General Plan Amendment.
In accordance with our conversation during the meeting we are
requesting that this matter be returned to the City Council for
modification of Condition ~~30. We are proceeding as quickly as
possible with the engineering and construction of East side
(Condition 5) Improvements.
• We are requesting that one of the following modifications be
substituted for Condition 30:
1) Provide a bond or cash deposit for the future
installation of the signal only.
2) Install the signal now and have Cal-Trans turn it on
when appropriate.
3) Modify the condition to allow the future signal to be
installed once the updated Project Study Report is
completed.
Your assistance in resolving this matter would be greatly
appreciated. Please advise us if a letter of request should be
sent directly to the Council or if you will be able to institute
their request.

Dear Mr. Garibay:
Thank you for bringing your concerns to Caltrans on February 16,
1988 regarding the various means of improving the traffic flow on
Telegraph Canyon Road aY, the Route 805/Telegraph Canyon Road
interchange.
We understand that the City of Chula Vista has made the
installation of signals on the west side of the interchange a
• condition for approval of the Rancho del Sur development. This
will confirm our response to you in the meeting, that further
work in addition to the signals, will be needed. Widening of the
southbound off-ramp to two lanes will be necessary in order to
allow sufficient storage for the new signals to function
properly.
