After several meetings to discuss these issues during March and April of 1988, City and IAFF representatives have formulated an amendment to the current M.O.U., and that amendment has been ratified by the IAFF membership. RECOMMENDATION: That Council adopt the resolution approving the amendment to the M.O.U. • BOARDS COMMISSIONS RECOMMENDATION: Not a licable. / PP DISCUSSION: The proposed LAFCO Terms and Conditions (copy of most recent version attached) for the Bonita annexation would result in the following Bonita/Sunnyside Fire District staff being absorbed by the City on the annexation's effective date: 1 Fire Chief as a City Battalion Chief 3 Fire Captains as City Fire Captains 6 Fire Engineers as City Fire Engineers 3 Fire Fighters as City Fire Fighters 1 District Secretary in a currently undetermined clerical position in the City The City's firefighters in Local 2180 expressed concerns about how the absorption of the above staff might affect their promotional opportunities in the future. The proposed amendment to the M.O.U. is intended to address those concerns, as well as similar concerns that have been raised by Bonita/Sunnyside Fire District staff. The proposed amendment to the M.O.U. would only become effective if and when the Bonita annexation became effective. In that case, the amendment would replace an existing section in the current M.O.U. regarding transitional • staffing levels resulting from the City's absorption of the Montgomery Fire Protection District. The proposed changes to the existing M.O.U. provisions are summarized below: PAGE 2, ITEM 7 MEETING DATE 4/19/88 • - The City will provide a minimum of 24 Fire Captain positions until a new fire station is opened. This is an increase of three Captain positions from the minimum of 21 Captain positions required in the current M.O.U. - The City will provide a minimum of 25 Fire Engineer positions until a new fire station is opened. This is an increase of three Engineer positions from the minimum of 22 Engineer positions required in the current M.O.U. The City will "grandfather" an additional three Engineer positions (for a total of 28 Engineer positions) until any of the six individual Engineers absorbed from the Bonita/Sunnyside Fire Protection District retires, terminates, promotes, or demotes. This minimum number of 28 Engineer positions will be reduced by one for each such Engineer (absorbed from Bonita) leaving an Engineer classification in any of the above methods. When the third such Engineer retires, terminates, promotes, or demotes, there will no longer be a minimum number of required Fire Engineer positions, unless the minimum of 25 described above is still required at that point as a result of the City not having opened a new fire station by then. • ~_J The City is currently required to provide a minimum of 5 Battalion Chief positions until any of the existing Battalion Chiefs retires, terminates, or promotes. If none of the existing Battalion Chiefs do so prior to the effective date of the annexation, the City's commitment would be increased to a minimum of six Battalion Chiefs until any of them retires, terminates, demotes, or promotes. At that point the minimum would be reduced to 5 until the Battalion Chief absorbed from the Bonita/Sunnyside Fire Protection District retired, terminated, demoted, or promoted.
