removal of one small shed from the Midbayfront

On March 5, 1988, the Bayfront Conservancy Trust sponsored a general clean-up
of the Gunpowder Point area of the Bayfront. No Coastal Development Permit is
required for such work. During the clean-up a small shed in the mid-Bayfront
was removed (location shown on Exhibit A). While the landowner authorized the
removal of the shed, no permit was obtained. Dr. Steven Neudecker, acting as
the agent for the landowner, is now seeking a permit for the demolition and
removal of the shed, after-the-fact. The project is exempt from environmental
• review under CEQA Guidelines pursuant to Section 15301 Class 1(1)(4).
RECOMMENDATION: That the City Council conduct a public hearing and consider
and approve the attached resolution and findings therein:
1. Finding that the proposed project is consistent with the policies of
the certified LCP; and
2. Issuing Coastal Development Permit #029.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The following events led to this Coastal Development Permit Request:
1. On March 18, 1988, the Chula Vista Investment Company informed the
City that a small shed had been demolished and removed from the
Midbayfront without a Coastal Development Permit.
?_. Dr. Neudecker on behalf of the Bayfront Conservancy Trust was
contacted and stated that the shed had been removed under his
direction without a Coastal Development Permit.
He was then informed that a Coastal Development Permit application
was required.
• 3. On March ?,4, 1988, Dr. Neudecker submitted a completed application
which triggered the scheduling of this public hearing.

Based on the following findings, the proposed project is consistent with the
policies of the certified Chula Vista Local Coastal Program:
1. The shed was located on the portion of the Midbayfront zoned for
office park use. Removal of the shed is consistent with the planned
use of the site.
2. The demolition of the shed improved the visual quality of the
Midbayfront and thus is consistent with the LCP form and appearance
guideline which states: "Improve the visual quality of the shoreline
by promoting public and private uses which provide proper
restoration, landscaping, and maintenance of shoreline areas."
3. The demolition of the shed also removed a blighting influence on the
area consistent with the form and appearance guideline which states:
"Remove, or mitigate by landscaping, structures or conditions which
have a blighting influence on the area."
