The property to be developed as Sunridge Park, located at East "J" Street a~od
Beechglen Drive, was given to the City by the developer, Pacific Scene,
fulfill the development's park requirements. San Diego Gas & Electric (SDG&E)
has a 250-foot wide easement on the site, which encompasses most of the park.
SDG&E requires that the City enter into a Right-of-Way Use Agreement for use
of the easement property as a park.
RECOMMENDATION: That the City Council adopt the resolution approving the
Right-of-Way Use Agreement.

Attached to the resolution is a copy of the proposed agreement. Basically,
SDG&E is granting the City permission to use the easement for a park, with
improvements as approved by the Council. According to the agreement, the City
shall agree to install and maintain only the improvements listed in the
attached exhibit; assume all risk for the City's use of the property; and
carry comprehensive general liability insurance naming SDG&E as additional
insured. SDG&E has the right under Public Utilities Commission regulations to
withdraw permission for this use at any time, in the interest of its patrons
or consumers. SDG&E may also withdraw permission should the City fail to
maintain the park under the terms of the agreement.
The City's Risk Manager and City Attorney's office have reviewed the agreement
and have no concerns with the terms.
FISCAL IMPACT: Not applicable.
