HomeMy WebLinkAboutAgenda Statement 1988/04/05 Item 14COUNCIL AGENDA STATEMENT • Item 14 Meeting Date 4/5/88 ITEM TITLE: Resolution ~,3 `~ Authorizing the Eastlake Development Company to construct a portion of Otay Lakes Road from Rutgers Avenue to the eastern boundary of the Eastlake Business Center and receive a cash or credit reimbursement as determined by the City against Development Impact Fees required by Ordinance No. 2251 at the time building permits are issued for the developer's project ~~, SUBMITTED BY: Director of Public Works REVIEWED BY: City Managerf~~~,,/r~ (4/5ths Vote: Yes No X ) The Eastlake Development Company has requested authorization to construct a portion of Otay Lakes Road from Rutgers Avenue to the eastern boundary of the Eastlake Business Center and receive a cash or credit reimbursement against Development Impact Fees pursuant to Ordinance No. 2251 adopted January 12, 1988. The Environmental Review Coordinator conducted an Initial Study, IS-88-19, of • potential environmental impacts due to the implementation of this project. Based on the Initial Study and comments received, the Coordinator concluded that there would be no significant environmental impact and recommended that the City Council adopt a Negative Declaration for the project. RECOMMENDATION: 1. Based on the Initial Study and comments on the Initial Study and Negative Declaration (copies of all attached), find that this project will have no significant environmental impacts and adopt the Negative Declaration issued on IS-88-19. 2. That City Council adopt the resolution. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Ordinance No. 2251 established a Development Impact Fee to pay for transportation facilities in the eastern territories of the City. The ordinance provides that a developer may request authorization from the City Council to construct one or more of the transportation facilities listed in the ordinance. • • Page 2,-Item 14 Meeting Date 4/12 88 The segment of Otay Lakes Road from Rutgers Avenue east approximately 4400 feet to the western boundary of the Eastlake Business Center as a 4-lane major road on 6-lane graded facility is one of the facilities listed in the ordinance. Also the segment through Eastlake Business Center is constructed on the south side, but needs to be constructed on the north side and is one of the facilities in the ordinance. It is anticipated that most of the major projects listed in the ordinance establishing the Development Impact Fee will be built by developers and/or assessment districts and that developers will earn credits against future fees at the building permit stage. There will be relatively few projects that will be funded directly by the Development Impact Fees. Should the credits from future projects not be enough to offset the developer's front-end expense for a particular project, the City will reimburse additional monies to the developers at the time that the City feels there are adequate funds to do so and that reimbursement will not delay needed future projects. Attached is a copy of the request for authorization to construct which contains a description and cost estimate of the improvements along with other information and statements as required to be submitted to the City Council. FISCAL IMPACT: None to the City. The Eastlake Development Company will advance all necessary funds to construct the project and will receive a credit or cash reimbursement in accordance with the provisions of Ordinance No. 2251.
