Resolution - Amending Master Fee Schedule to include a License Fee for Casino Parties SUBMITTED BY: Director of Public S~fet (4/Sths Vote: Yes No XX) Y REVIEWED BY: City Manage The use of Casino or Las Vegas type parties in San Diego County has increased among competitive fund raising organizations. The City of Chula Vista received four (4) requests for this type of event during 1987, one of which was approved. The Police Department inspected this Casino Program and observed several violations of State Gaming Laws; however, there is currently no reference to regulating Casino Parties within Chula Vista's Municipal Code. • The City and County of San Diego have each adopted ordinances governing the operation of these events. Attached is the proposed Ordinance for Chula Vista, patterned after the City and County, which is designed to combat illegal gambling and protect the public from fraudulent charitable events. RECOMMENDATION: Adopt the Ordinance regulating the operation of Casino parties within the City of Chula Vista and place it on the first reading BOARDS/COMMISSIONS RECOMMENDATION: N/A DISCUSSION: As a result of approving a local church's request to hold a Casino Night fund raiser, the Police Department became aware of several State Gaming Law violations common to these types of events. However, the Municipal Code makes no mention of Casino Parties within the section on gambling. The main concern of the Police Department is protecting the citizens of Chula Vista from innocently becoming involved in an illegal gambling operation. The proposed Ordinance will amend Chapter 9.12 - Offenses Against Decency-Gambling by adding Sections 9.12.250 through 9.12.340 specifically relating to Casino Parties. The new Sections in general provide guidelines for licensing and lawful operation of a Casino Night Party. Specific requirements include the following: LICENSING 1) Applicant must be a member of a non-profit, charitable organization • 2) Each organization may not have more than 2 such parties in one calendar year 3) A completed application must be received by the Police Chief at least 15 days prior to event including informa- tion about the organization, all volunteers and source of equipment. 4) Any application which is denied can be appealed to the City Council GENERAL EVENT RULES 1) Event must be accessible to police, open to the public, excluding minors and closed between 2:00 - 6:00 AM 2) There must be no correlation between the amount of chips and scrip received and money donated 3) All prizes must be awarded by raffle or lottery. Total value of prizes not to exceed $5,000, no single prize to exceed $2,500 and no cash prizes are allowed • Page 3 , Item ~'`~ ~3 • 4) All advertisement of event must state that no purchase or donation is required in order to participate, and the event is open to the public Through adoption of this Ordinance, we will provide non profit, charitable organizations with a viable and legal alternative for their fund raising events. FISCAL IMPACT All applications for a Casino License shall be accompanied by a fee of $50 for conducting the investigation of the applicant. The proposed Resolution will amend the existing Master Fee Schedule to include the $50 casino fee under new Section 9.12.280. Based on the number of requests for casino parties during 1987, total anticipated revenue would be approximately $200.
