RECOMMENDATION: That the Council accept the report and adopt a resolution establishing the following policy with respect to reductions in sideyard setbacks for single-family residential units containing three-car garages: • 1. sideyard setbacks for lots containing three-car garages may be reduced to 5 feet on each side, provided that each sideyard area does not exceed a 2% grade and a minimum separation of 10 feet remains between structures. 2. A maximum of 33% of the lots in a proposed subdivision may provide reduced sideyard setbacks for units containing three-car garages. 3. Garage conversions shall not be permitted for three-car garages where reduced setbacks occur. BOARDS/COMMISSIONS RECOMMENDATION: On November 18, 1987, the Planning Commission, by a vote of 5-0, recommended that the City Council adopt the policy as recommended by staff. BACKGROUND: On June 16, 1987, the City Council reviewed the Bel Air Ridge Estates tentative subdivision map which included a request by the applicant for a reduction of sideyard setbacks for units with 3-car garages similar to that of a previously approved subdivision (Casa Del Rey). The Council voiced concerns with the proposed reductions and decided to approve the tentative map subject to the deletion of provisions for reduced setbacks. The Council also requested that staff return to them with a report analyzing the pros and cons of sideyard reductions for units with 3-car garages. • Development standards for the 178 unit Casa Del Rey subdivision were approved on May 7, 1985, and permit the reduction of sideyard setbacks from 10 feet and 3 feet to 5 feet and 5 feet for units with 3-car garages. A maximum of 33% of the lots were approved for this reduction.
