HomeMy WebLinkAboutAgenda Statement 1988/01/12 Item 20COUNCIL AGENDA STATEMENT • Item 20 Meeting Date 1/12/88 ITEM TITLE: Public Hearing: Amendment to the Conditions of Approval for Coastal Development Permit #004 RESOLUTION/3y~~Adopting Negative Declaration IS-86-42 and Addendum thereto and authorizing the amendment of the Conditions of Approval for Coastal Development Permit #004 to allow grading activities on the project site within the period from November 1 to April 1 each year SUBMITTED BY: Community Development Director ~- ~~ REVIEWED BY: City Manager ~ ~~/~ ~ (4/5ths Vote: YES_NO X ) On September 2, 1986, the City Council authorized the issuance of Coastal Development Permit #004 to National Avenue Associates for grading and filling on their property located within the inland parcel. The authorization for issuance of the permit was, however, subject to the six conditions listed in Exhibit A. At this time the applicant is requesting the deletion of Condition of Approval #4 which prohibits all grading activities within the period from November 1 to April 1 of each year. RECOMMENDATION: That the City Council conduct a public hearing and consider • and approve the attached resolution and findings therein: 1. Adopting Negative Declaration IS-86-42 and Addendum thereto. 2. Finding that the proposed amendment is consistent with the policies of the certified LCP; and, 3. Authorizing the Amendment of the Conditions of Approval for Coastal Development Permit #004 to allow grading activities on the project site within the period from November 1 to April 1 each year. BOARDS/COMMISSIONS RECOMMENDATION: Not Applicable DISCUSSION: Coastal Development Permit #004 permitted the applicant to place ±150,000 cubic yards of imported earth on an area of approximately 9 acres south- east of the intersection of Broadway and the Sweetwater River Flood Control Channel. The controlled fill area is set back 100 feet from the identified wetland area. Prior to the placement of fill, "silt-stop" sediment control fencing was installed 10 feet from the toe of the fill. This measure and the 100 foot set back were required to minimize the potential for siltation in the wetland. In addition, at the time Coastal Development Permit #004 was issued, the grading prohibition between November and April in the certified LCP was interpreted to include the inland parcel. As a result of that interpretation, Condition of Approval #4 which prohibited grading between November 1 and April 1, was recommended for the proposed project. • The Negative Declaration attached as Exhibit A reflects the project description above. Page 2, Item 20 ' Meeting Date 1/12/88 • Based on recent conversations between the City's consultant, Norbert Dall, and the Coastal Commission attorney, that interpretation has been revised. Exhibit B details the reasons that the grading prohibition is no longer interpreted to include the inland parcel. Exhibit C is an addendum to Negative Declaration IS-86-42 that was prepared in compliance with Section 15164 of the CEQA Guidelines. In preparing the addendum the potential for eliminating the prohibition on grading during the rainy season to result in a significant increase in siltation in the wetland was evaluated. This potential impact was considered less than signifi- cant because the following erosion control measures are still included in the project. -The controlled fill is set back 100 feet from the wetland. -A silt-stop sediment fence has been installed 10 feet from the toe of the fill to prevent siltation in the Sweetwater River. Based on the following findings, the proposed amendment has been found to be consistent with the policies of the certified Chula Vista Local Coastal Program. 1. Consistent with the requirement in Section 197.07 that "Special care shall be taken at the marshes to reduce problems of silting..." a silt fence has been installed on the project site and the permitted work is 100 feet from the area identified as wetland. • 2. Consistent with Section 19.87.07, the silt fence, an erosion control device, was installed prior to on-site grading. 3. The prohibition on grading activities between November 1 and April 1 each year does not apply to the inland parcel because that area is not a part of "the project" as shown on Map 5, Planned Land Form: Grading/Filling and Drainage.
