The proposed project is exempt from environmental review under the CEQA guidelines pursuant to Section 15301 Class 1 (1)(4). The graphic, attached as Exhibit A, shows the location of the four sheds proposed for demolition. • RECOMMENDATION: That the City Council conduct a public hearing and consider and approve the attached resolution and findings therein: 1. Finding that the proposed project is consistent with the policies of the certified LCP; and, 2. Issuing Coastal Development Permit #035 subject to the requirements in Finding #1. BOARDS/COMMISSIONS RECOMMENDATION: Not Applicable DISCUSSION: The proposed project involves the demolition and removal of four small huts adjacent to and on the east side of the deteriorating nursery structures in the Midbayfront. The following events led to this Coastal Development Permit request. 1. On November 20, 1987, Jack Dimond was informed that demolition work was being conducted on the huts in the Midbayfront in violation of Section 19.92 of the Chula Vista Bayfront Specific Plan which requires that a Coastal Development Permit be obtained prior to undertaking such work (see Exhibit B). 2. On December 7, 1987, Mr. Dimond responded with a Coastal Development Permit application and a request that the City red-tag the buildings for • immediate removal. He stated that the buildings were structurally unsafe because the majority of the sectional locking devices had been removed. Item 18, page 2 • Mr. Dimond agreed to continue processing the required paperwork (see Exhibit C). 3. On December 11, 1987, Mr. Dimond's Coastal Development Permit application was returned to him with information on how to complete his submittal (Exhibit D). 4. On December 17, 1987, following an inspection of the buildings, it was the conclusion of the inspector that all of the huts except the one located furthest south were structurally safe. The one located furthest south required the replacement of approximately 10 bolts in the center section to make it structurally safe. Because the bolts had recently been removed, it was suggested that they be replaced until the required permits could be processed (Exhibit E). 5. On December 21, 1987, Mr. Dimond resubmitted a complete Coastal Development Permit package which triggered the scheduling of this public hearing. Based on the following findings, the proposed project is consistent with the policies of the certified Chula Vista Local Coastal Program: 1. Consistent with the grading and drainage requirements in Section 19.87.07 of the Specific Plan, siltation in wetland areas resulting from site run-off will be minimized by requiring the applicant to conduct re- • moval of foundations and any backfilling that may be required between April 1 and November 1. In addition, the area beneath the foundation will be required to be planted within 60 days of initial disturbance and prior to November 1. Finally, the planting shall be done under the supervision of a licensed landscape architect and will provide seeding, mulching, fertilization, and irrigation adequate to provide 90 percent coverage within 90 days (planting will be repeated if adequate coverage is not established). 2. The huts are located on the portion of the Midbayfront zoned for office park use. Removal of the huts is consistent with the planned use of the site. 3. The demolition of the huts would improve the visual quality of the Midbayfront and thus is consistent with LCP form and appearance guideline which states: "Improve the visual quality of the shoreline by promoting public and private uses which provide proper restoration, landscaping, and maintenance of shoreline areas". 4. The demolition of the huts would also remove a blighting influence on the area consistent with the form and appearance guideline which states: "Remove, or mitigate by landscaping, structures or conditions which have a blighting influence on the area".
