The proposed subdivision consists of 14 single family residential lots and two open space lots (A and B) located northeast of Otay Lakes Road at the southeast terminus of Camino Elevado. The boundaries of the proposed district are shown on Exhibit "A". • RECOMMENDATION: That the Council adopt a resolution declaring the Council's intention to form the proposed open space district and setting the date, time and place for a publ i c hearing on the proposed district as January 26, 1988, at 7:00 p.m. in the City Council Chambers in accordance with Section 17.08 of the Municipal Code. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The City Council, by Resolution 12843, (December 9, 1986 ) approved the Tentative h1ap for Chula Vista Tract 87-1, Corona Vista Subdivision. Item 2 of said Resolution 12443 stated, "The developer shall grant to the City an open space easement over lots A and a in order to restrict development on these lots. An open space maintenance district shall be formed for the maintenance of open space lots A and B, to be activated as necessary at the discretion of the Chula Vista City Council." The developer, Corona Vista Partnership, has requested in a letter dated July 8, 1987 that an open space district be formed in compliance with the requirement of the Planning Commission and the City Council resolutions. Lots A and B are designated as open space and were granted to the City for that purpose. It is the City's intent to form the open space district at this time. However, the district will not be activated until such time the City Council determines that it is necessary to do so. Meanwhile, the maintenance of said open space lots A and B will be done by the homeowner's association as provided in the CC&R's for this development. The activation of the district would be done at a future date if citizen complaints or staff observations indicates that the riome owners are not maintaining the landscaping to Counc i 1 ' s sati sfacti on. There woul d be a publ i c hearing with i nput from the subject properties. Said CC&R's includes a statement indicating that the City has the right to form and activate the open space district at any time. The developer's landscape architect estimates that the annual cost of maintaining the slopes will be $2,397.70 or $171.26 per lot. In compliance with Section 17.08.150 D.2 of the City Municipal Code, since the Planning Commission has previously reviewed the Open Space area through the subdivision process, the matter is going immediately to City Council without need for a second Planning Commission review.
