REVIEWED BY: City Manager ~ ~i ~ (4/5ths Vote: Yes No X ) Kids Unlimited, Inc. has requested that the City quitclaim an easement and right-of-way for ingress and egress and for road and water pipeline purposes as granted by Grant Deed on January 18, 1968, and recorded on March 14, 1968. These easements were acquired as part of parcels acquired through a final order of condemnation in an action brought by the City on September 11, 1980. Staff has reviewed this easement and found it to lie within the excess piece of property, recently purchased by Kids Unlimited, Inc. from the City of Chula Vista, located at Telegraph Canyon Road and Paseo Del Rey. RECOMMENDATION: That Council authorize the Mayor to execute the attached Quitclaim Deed for the easement across the Kids Unlimited, Inc.-owned property. • BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The concerned easement and right-of-way for ingress and egress and water pipeline purposes were granted on September 11, 1980, to the City with Parcel IV and V through a final order of condemnation. Since the excess remainder of the two parcels were sold to Kids Unlimited, Inc., the City is no longer in need of these easements. The City owns the right-of-way for Telegraph Canyon Road and the drainage channel in fee. Attached is the Quitclaim Deed to be executed and a plat showing the easement and Parcel IV and V.
