HomeMy WebLinkAboutAgenda Statement 1987/12/15 Item 13COUNCIL AGENDA STATEMENT • Item 13 Meeting Date 12/15/87 ITEM TITLE: Resolution~~3 ~~ Approving agreement between City of Chula Vista and South Bay Pioneers guaranteeing construction of street improvements along south side 200 block of "C" Street SUBMITTED BY: Director of Public Works REVIEWED BY: City Manager ~~ ~ (4/5ths Vote: Yes No X ) On October 28, 1986, the City Council approved Conditional Use Permit PCC-87-8 to construct 18 residential units at 270 "C" Street. The property is owned by South Bay Pioneers who is currently constructing the 18 units under the authority of a building permit issued by the City. As a condition of approval of the Conditional Use Permit and Building Permit, South Bay Pioneers is required to install the street improvements along the south side of "C" Street lying adjacent to their property. Prior to the City allowing occupancy of the units, South Bay Pioneers must complete the construction of the street improvements or enter into an agreement with the City which guarantees their construction. • RECOMMENDATION: Approve the agreement. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: South Bay Pioneers is rapidly approaching the point in time whereby they will want to occupy the 18 units under construction and which are near completion. They expect this to occur sometime in December. To date the required street improvements have not been constructed, but there is a reason for this. The City needs to reconstruct a portion of "C" Street before South Bay Pioneers can construct theirs. A soils investigation shows that a portion of the roadway embankment must be removed and recompacted. The cost of the entire project is estimated to cost $210,000. In the FY 87-88 Capital Improvement Program, $160,000 in Community Development Block Grant funds were budgeted for the City's participation in the cost of these improvements. South Bay Pioneers is responsible for any cost of the project which exceeds this amount. The attached agreement will provide the mechanism by which the South Bay Pioneers will be allowed to occupy the 18 residential units and guarantee that street improvements will be constructed. • • Page 2, Item 13 Meeting Date$7 The specific terms of the agreement are as follows: 1. City will contribute funds in the maximum amount of $160,000. (Budgeted Community Block Grant funds.) 2. South Bay Pioneers will be responsible for all project costs which exceed $160,000. This includes cost of improvements, engineering, surveying, soils investigation and testing, inspection, project management, utilities relocation and right-of-way acquisition. 3. City will prepare the required environmental review, plans, specifications, cost estimate, advertise for bids and cause the improvements to be constructed under a City Public Works Contract. 4. City will provide all engineering, surveying, soils investigation and testing, inspection, project management, utilities relocation and right-of-way acquisition. 5. South Bay Pioneers will deposit with the City Finance Officer the sum of $50,000 after approval of this agreement and before occupancy of any of the 18 apartment units. Interest shall accrue to this deposit and shall only be used to pay the cost of the project that exceeds $160,000. If the • $50,000 and accrued interest is not sufficient to cover project costs which exceed $160,000, South Bay Pioneers will deposit additional funds with the City Finance Officer upon written notice by the City Engineer, Upon completion of the project, any excess funds deposited by South Bay Pioneers which are not needed shall be returned to South Bay Pioneers. 6. South Bay Pioneers agree to grant any right-of-way or letters of entry required for the construction of the improvements. Design of the project is scheduled to begin in August 1988 with construction starting in December 1988. FISCAL IMPACT: City will contribute a maximum of $160,000 towards the improvements.
