Several offers of dedication of land for street purposes were included on that map. The territory was unincorporated at that time and the Board of Supervisors accepted some of the offers and rejected others. The subject of this report is that offer of dedication which designated a "portion of Lot 10 reserved for future street" for Dixon Way (see Exhibit B). RECOMMENDATION: That the City Council rescind the previous action by the County of San Diego rejecting the offer of dedication and adopt a resolution accepting the right-of-way as shown on Map No. 9221. • BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Recently Mrs. Ramona E. Corona applied for a building permit to construct a church within the property at 1271 First Avenue. One of the City's requirements was that she provide access for fire protection from Dixon Way. This property has frontage on First Avenue along the westerly side. The easterly side is separated from Dixon Way by a 1 foot strip reserved for future street and is a portion of the adjacent property, lot 10. This one foot strip was offered for dedication to the County of San Diego on May 15, 1979 (see Exhibit A). The County of San Diego rejected that offer of dedication. A conditional use permit for the church was granted by the County of San Diego. A condition of this use permit was that no traffic from the church site was to be generated onto Dixon Way. Controlling access onto Dixon Way can be accomplished by requiring the applicant to construct a gate and fence across the frontage of Dixon Way and provide a Knox Box for the Fire Department. In this manner only the Fire Department would have a key and access to and from Dixon Way. • • Page 2, Item 9 Meeting Date~]$7 One other factor to consider, is that double access to a property from two abutting streets, is not normally allowed. Consequently, the provision of access for only the Fire Department is required. We are proposing that this offer of dedication be accepted for the sole purpose of allowing the applicant to comply with the Fire Department requirement for access from Dixon Way. This property is now in the City of Chula Vista. Consequently, Mrs. Corona has requested that the City Council accept the offer of dedication for the portion of Lot 10 along Dixon Way so that she can obtain a construction permit for a driveway from Dixon Way. Section 66477.2 of the Government Code of the State of California provides that a rejected offer of dedication shall remain open and subject to future acceptance by the governing agency. The City Council, therefore, may now accept the offer and adopt a resolution naming the subject portion of Lot 10 as Dixon Way. FISCAL IMPACT: None.
