The contractor had 35 working days to complete the project. Due to rain and unexpected difficulty in removing the stamped concrete in the median, the contractor will be unable to complete the project within the specified period and has requested a contract time extension. RECOMMENDATION: That Council adopt a resolution approving extension of contract time to December 31, 1987. ~OARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: 0 & B Matthews Construction Inc. was awarded a contract to modify the East "H" Street centerline median at Auburn Avenue to permit the installation of bike lanes in this portion of East "H" Street. The contract was for a 35 working day period, which commenced on October 12, 1987, and expired on December 1, 1987. Since then we have had rainfall a total of four (4) days. Due to wet conditions, the contractor was unable to work on two (2) days. Thus, the contractor is eligible for a contract time extension of six (6) days due to adverse weather. In addition to requesting an extension of contract time based on adverse weather, the contractor has requested an additional extension of fifteen (15) days due to unexpected difficulty in removing the stamped concrete in the median. Their request is for a total of twenty one working days, which would extend the contract to December 31, 1987. The contractor is entitled to an extension of time if the delays are caused by unforeseen events beyond his control. We concur with the contractor and the City Council.
