Mr. Charles K. Harlan, owner of the property at 242 Kennedy Street has
proposed the placing of a temporary classroom on the property. In accordance
with the City Code, he is required to underground any overhead utility lines
existing on the parcel, plus undergrounding all the utility services. He has
applied fora deferral of this requirement. His request must be considered by
Council at a public hearing.
RECOMMENDATION: That Council hold the subject hearing and adopt the
resolution approving the deferral of the requirement to underground the
• existing overhead distribution lines but require the undergrounding of the new
service.

DISCUSSION:
Background
Mr. Charles Harlan, owner of the subject property recently applied for a
building permit to place a temporary classroom (a combination of mobile units)
36x50 feet in area. There is an existing permanent classroom also on the
site. According to Mr. Harlan, the temporary classroom will be. there three
years at which time he intends to construct a permanent building and remove
the temporary facility.
The existing permanent building is presently being served by overhead lines
from a pole that appears to be on the property to the east of h9 r. Harlan's
parcel. However, Mr. Harlan states that the poles are on his property. The
service to the permanent building is not proposed to be converted, nor is Mr.
Harlan required to underground this existing service.
Due to the placement of the temporary classroom on his site, the requirement
to underground the overhead distribution and service lines has been imposed.
By letter dated October 22, 1987, the owner requested a deferral of the
conversion requirements, stating the cost would cause an undue financial
• hardship on him. He states that SDG&E gave him a rough estimate of $15,000 to
convert the existing lines on the property.

Findings
1. Section 15.32.070 of the City Code provides for deferrals of
undergrounding requirements if it can be shown that enforcement of these
requirements would cause undue hardship and that the deferral would not be
detrimental to the safety and general welfare of the public.
2. If the estimate by SDG&E is correct, the conversion costs would be 25q of
the cost of the improvements on the property.
3. The deferral, if granted, would not be detrimental to the welfare of the
citizens.
4. Undergrounding the service to the new temporary classroom should still be
required, as the structure is close to the street and the electrical panel
is on the outside of wall facing the street. It is estimated the cost to
accomplish this would be approximately $600: $340 for SDG&E and $260 for
trenching, conduit and backfill.
5. It is our intention to enforce the conversion requirements when Mr. Harlan
constructs his additional permanent structure.
• Conclusion
With concurrence from the Planning Department, it is recommended that the
request be approved and the resolution approving the deferral of
undergrounding the distribution lines on site but require the undergrounding
of the new service be adopted.
