The plans were processed through the County, as the project was started in 1985. As part of this development, the church was required to submit an Irrevocable Offer to Dedicate 30 feet of right-of-way for Walnut Drive. The City should now relinquish its interest in that irrevocable offer. RECOMMENDATION: That Council: a) adopt a resolution ordering the release of the offer to dedicate a 30 ft. easement along the northerly boundary of the subject property, and b) accept the 17.5 foot roadway easement along the • southerly boundary parallel and adjacent to Walnut Drive. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: In October, 1985, the Chula Vista Congregation of Jehovah's Witnesses applied to the County of San Diego for a major use permit to construct a church at 72 Walnut Drive. A condition of approval for the major use permit was that the owners execute an irrevocable offer to dedicate real property for public highway within a strip of land 30 feet from the centerline of Walnut Drive (see Exhibit A). The owners engaged the services of a local Civil Engineer to author the description and submit the necessary documents for recordation. The Engineer made an error in describing the dedication, placing said dedication along the northerly boundary of the property rather than along the southerly boundary parallel to Walnut Drive. The County staff did not discover the error in the description, hence the offer of dedication placed the future easement in the area in which the church building is to be located. • Page 2, Item 7 Meeting Date~TJ~J$7 The owners attempted to have the County of San Diego relinquish their interest in the easement. However, this was not possible since, with the annexation, the City of Chula Vista became the beneficiary of all rights, easements and rights-of-way that the County previously enjoyed. Consequently, the owners have applied to the City for the release of said easement. The document granting the street easement in its correct location has been executed by the owners and submitted to the Public Works Department.
