The • Final Map for Woodland Park Subdivision and associated items are now before Council for approval. RECOMMENDATION: That Council adopt the resolutions listed in the item title above. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Chula Vista Tract 82-1, Woodland Park, consists of 27 single family lots. The Final Map for said subdivision has been reviewed by the Engineering Department and found to be in conformance with the approved Tentative Map. The developers have complied with all relevant conditions of approval. Approval of the map constitutes acceptance of all drainage, sewer and access easements within the subdivision, acceptance of Derek Way and portions of Main Street, Spruce Road and Lotus Drive on behalf of the public, and acceptance of any and all abutter's rights of access in and to Main Street adjacent and contiguous to Lot C. Approval of the map includes rejection of an offer to dedicate lots C, D, and E for Open Space purposes, reserving the right to accept said offer at an unspecified future date. Lots C, D, and E are to be maintained by the homeowner's association. • However, the irrevocable offer to dedicate provides a mechanism so, in the event that a maintenance district needs to be established to provide adequate maintenance for slopes in Lots C, D, and E, the City will be able to activate said district. The public hearing on said Open Space District is being held as a separate action this meeting. Page 2, Item 22a, b, c Meeting Date-T'f7TT/~$7 The developers are unable to obtain surety bonds to guarantee the subdivision improvement agreement until the City Council has approved the Final Map. As provided for in the City Code, it is proposed that Council approve the Final Subdivision Map subject to the condition that the Final Map not be released for recordation until acceptable bonds are provided. The Tentative Map for the project expired on November 13, 1987. A recent revision to the subdivision map act allows the Council to approve a final map after the expiration date of the Tentative Map, providing that the map is filed with the City Engineer (with all appropriate documents and fees) prior to the expiration date. The City Engineer determined on November 12, 1987, that the submittal was complete, in accordance with the Map Act. On October 13, 1987, the City Council approved Resolution 13228 deferring the requirement for undergrounding of overhead utilities within the subdivision. The developer has executed an agreement wherein he agrees, on behalf of his successors in interest, to not protest formation of an undergrounding district. That agreement is now before the Council for approval. As a condition of approval of the Tentative Map, the developer was required to enter into an agreement to waive the right to protest the formation of a district for the purpose of providing sewer capacity to the area. • A plat is available for Council viewing.
