HomeMy WebLinkAboutAgenda Statement 1987/11/10 Item 10COUNCIL AGENDA STATEMENT • Item to Meeting Date 11/10/87 ITEM TITLE: Resolutioni~z-} Rescinding Council Resolution No. 13291 and granting easements to Lincoln Hilltop usiness Center SUBMITTED BY: Director of Public Works Gf~''~--~ REVIEWED BY: City Manager (4/5th Vote: Yes No X ) Easements in Palm Road (see exhibit) were granted by Council Resolution No. 13291 to Hilltop-Main (original land owners) for portions of a retaining wall at the easterly end of its property at the northeast corner of Hilltop Drive and Main Street. As the documents were being processed by the City, the ownership of the property changed to Lincoln Hilltop Business Center. In order to make the easement recordable, it is necessary to rescind that resolution and adopt a new one naming the new owner as the grantee. RECOMMENDATION: That the Council adopt the subject resolution and authorize the Playor to sign a new grant deed on behalf of the City. • BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: We learned after the Council meeting that escrow closed resulting in the easements being granted to the former owner. We now should rescind the previous resolution and grant the easements again to the new owner, Lincoln Hilltop Business Center.
