Public hearing to consider the vacation of a portion of
Broadway at the northwest corner of its intersection with
Anita Street

The Council held a public hearing on this matter on January 6 of this year.
At the close of this hearing, staff was directed to work with the applicant to
obtain more information on the traffic patterns in the area. That data has
been collected and is now ready for Council consideration. At its meeting on
October 13, Council adopted the Resolution of Intention No. 13273 and set
November 3, 1987, as the date for the public hearing.
RECOMMENDATION: That the Council hold its subject public hearing and direct
staff to return with a resolution vacating the property.

DISCUSSION:
Mr. William Perkins, owner of the property at 1550 Broadway, submitted an
application to this department requesting that the City vacate a portion of
Broadway right-of-way along the frontages of his property and the property to
the north. (Lots 2 and 3 of Starfire Sports Subdivision, h1ap No. 8017,
recorded September 11, 1974.) The reason given for the request is that his
property is substandard in terms of parking capacity. In order for the
applicant to fully use the lot in accordance with the zoning, additional
parking area is necessary.
At the public hearing held on this matter on January 6, 1987, the City Council
referred this matter to staff and directed that a traffic study be made to
determine the impacts of the proposed street vacation.
The consulting firm of Monroy-Lopez Engineering was selected to conduct the
study which would:
. Analyze the potential circulation and safety impacts
Set forth mitigation measures to reduce those impacts
Evaluate the effect of cumulative traffic.

The overall conclusion of the traffic study is that the proposed street
vacation would not have a detrimental affect on traffic circulation, would not
cause any changes in Levels of Service and could reduce some existing
operational conflicts.
The study found that approximately half of the 2,000 daily southbound trips on
this segment of Silvas Street continue south of Anita. Of these,
approximately 79~ continue all the way to tYtain Street and turn right. The
study concludes that these "short-cut trips" would continue on Broadway to
Main with insignificant impact to Broadway or Main, and with minor
inconvenience to the motorist.
Presently, there is a one-way travel lane aligned with Silvas Street (see
Exhibit "B"), a north-south substandard street which extends south from Anita
Street to Main Street, approximately 1,400 feet in length. Most of the
remaining southbound trips on the one-way portion of Silvas turn right on
Anita and proceed west. The proposed vacation would require these trips to
turn right to Anita from Broadway. To facilitate this movement, the northwest
corner of the intersection needs to be reconstructed to provide a 35 foot
radius curb return.
Because the existing intersection of Silvas Street and Anita is less than 100
• feet from Broadway and Anita, periodic conflicts between turning movements
occur. This was confirmed in the study using videotape analysis of the
intersection operation. The proposed vacation will eliminate the majority of
the "short cut traffic" and require all southbound to westbound right turns to
be made at Broadway, this resulting reduction in traffic conflicts can be
considered a positive impact.
Subsection 8324(b) of the California Streets and Highways Code states that if
the Council finds from evidence submitted by all interested persons that the
subject portion of the street described in the resolution of intention is
unnecessary for present or prospective public use, the Council may adopt a
resolution vacating said street. That paragraph also includes the provision
that the resolution of vacation may be conditioned so that the vacation does
not become effective until certain requirements have been fulfilled. In this
case, the following conditions are recommended to be imposed and shall be met
before the resolution is adopted:
1. A site plan is to be submitted and approved by the Design Review Committee
showing how the vacated land is to be used.
2. A complete set of improvement plans for the reconstruction of the Broadway
and Anita Street improvements shall be prepared by the applicant's private
engineer and the plans approved by the City Engineer.

3. Permits, bonds and agreements shall be submitted for the work in the
public right-of-way.

4. A parcel map shal 1 be prepared to i ncl ude the entire vacation as part of
the developed lot.
5. Developer shall pay the City the fair market value for the City's fee
interest in the land.
The right-of-way was deeded in fee to the County of San Diego. Since the
Montgomery annexation, the ownership reverted to the City of Chula Vista. An
appraisal will need to be prepared to determine the fair market value of the
vacated parcel. It is staff's position that the appraisal should be paid for
by Mr. Perkins, but the cost could be deducted from the sale price.
All utility companies owning franchises in our rights-of-way have been
contacted regarding the proposed vacation. We are reserving "blanket
easements" for SDG&E, Sweetwater Authority and Pacific Bell. Defined
easements, if necessary in the future, may be coordinated between the owner
and the respective utility.
The Planning Department has been contacted regarding this matter and staff has
no objections to the proposed vacation.
