ITEM TITLE: Resolution /.~s~.,~~ Accepting drainage easement for the
construction of the Telegraph Canyon Creek Flood Control
Channel Project

The Telegraph Canyon Creek Flood Control Channel Project was awarded by the
U. S. Army Corps of Engineers on October 28, 1987, to Commercial Contractors
Inc.
To construct the project, we obtained early in 1987 a drainage easement across
the SDG&E power plant. However, we abstained from requesting formal City
Council acceptance of this easement until the contract for the project was
formerly awarded by the Corps of Engineers.
RECOMMENDATION: That Council adopt resolution accepting the drainage
easement.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The Telegraph Canyon Creek traverses the SDG&E South Bay Power Plant from Bay
Boulevard to the San Diego Bay. The Corps of Engineers propose to construct a
trapezoidal channel through the power plant.
To this effect, early in 1987, the City Manager negotiated with SDG&E
officials to obtain the needed right-of-way. The Utility agreed to dedicate
the right-of-way (drainage easement) at no cost to the City. Due to the
uncertainty of the contract award date, staff withheld the acceptance of the
easement by City Council until now. This delay assured that the City would
not be obligated to maintain the unimproved open channel. Since the contract
for the project has been awarded,it is now appropriate to formally accept the
easement.
FISCAL IMPACT: Drainage easement was dedicated by SDG&E at no cost to the
City.
