ITEM TITLE: Resolution~c~~~~ Approving Encroachment Permit No.
PE-lU5 at 1076 Woodlawn Avenue
SUBMITTED BY: Director of Public Works/City Engineer
REVIEWED BY: City Manager n ~~ ~~ (4/5ths Vote: Yes No X )
The owner of the property at 1076 Woodlawn Avenue applied for an encroachment
permit into a utility easement in order to bring into conformance a structure
which is now existing. This structure is a 20x20 foot storage shed and
encroaches approximately 1 foot into the utility easement at the rear of the
property. The floor area within the above mentioned easement is approximately
20 square feet. This type of encroachment is one which may be approved by the
City Council only.
RECOMMENDATION: That Council approve the permit and authorize the City
Engineer to issue same.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
• DISCUSSION:
Recently, Mr. Wolfgram constructed a 20'x20' structure for the purpose of
storage. Construction was completed without a building permit or variance and
Mr. Wolfgram was required to obtain a permit after the fact.
In the course of obtaining the building permit, it was discovered that the
building encroaches into a 6 foot public utility easement by one foot. The
total encroachment is one foot with a length of 20 feet. This represents a
total area of approximately 20 square feet.
The easement is along the rear property lines and is used for overhead
electrical and communication facilities. '~
The utility companies have been informed and have responded indicating that
they have no objection to this encroachment permit with minor conditions as
follows:
Pacific Bell does not object providing the aerial clearance is a minimum of 8
eet.
SDG&E does not object as long as it is understood that Mr. Wolfgram agrees to
assume all risks of loss, damage, and injury to persons and property arising
from the use of the easement area, and that Mr. Wolfgram further agrees to
indemnify, defend and hold SDG&E harmless from any liability arising from the
• use of the easement area.
The proposed encroachment will not obstruct the view of any neighbors.
