This structure is a 20x20 foot storage shed and encroaches approximately 1 foot into the utility easement at the rear of the property. The floor area within the above mentioned easement is approximately 20 square feet. This type of encroachment is one which may be approved by the City Council only. RECOMMENDATION: That Council approve the permit and authorize the City Engineer to issue same. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. • DISCUSSION: Recently, Mr. Wolfgram constructed a 20'x20' structure for the purpose of storage. Construction was completed without a building permit or variance and Mr. Wolfgram was required to obtain a permit after the fact. In the course of obtaining the building permit, it was discovered that the building encroaches into a 6 foot public utility easement by one foot. The total encroachment is one foot with a length of 20 feet. This represents a total area of approximately 20 square feet. The easement is along the rear property lines and is used for overhead electrical and communication facilities. '~ The utility companies have been informed and have responded indicating that they have no objection to this encroachment permit with minor conditions as follows: Pacific Bell does not object providing the aerial clearance is a minimum of 8 eet. SDG&E does not object as long as it is understood that Mr. Wolfgram agrees to assume all risks of loss, damage, and injury to persons and property arising from the use of the easement area, and that Mr. Wolfgram further agrees to indemnify, defend and hold SDG&E harmless from any liability arising from the • use of the easement area. The proposed encroachment will not obstruct the view of any neighbors. • • • Page 2, Item 4 Meeting Date~787 I recommend that the Council approve the request and authorize the City Engineer to issue the encroachment after the the following conditions are met: 1. That owner submit a letter from Pacific Bell stating that the clearance requirement of 8 feet from the roof to any telephone line has been met. 2. That owner submit proof that the agreement as required by SDG&E has been entered into. Slides are available for Council viewing. FISCAL IMPACT: Not applicable.
