Meeting Date 10/13/87 ITEM TITLE: Resolution ~3~ ~ 3 Declaring the City's intention to vacate a portion of Broadway (formerly National Avenue} at Anita Street and setting a public hearing for the proposed vacation SUBMITTED BY: Director of Public Works/City Engineer ~h~~/J REVIEWED BY: City Manager (4/5ths Yote: Yes No_) Mr. William Perkins, owner of the property of 1550 Broadway, applied for the vacation of a portion of Broadway adjacent to his parcel in November 1986. A public hearing was held on January 6, 1987, at which time Council considered this matter. Subsequent to the close of the hearing, Council referred the matter to staff for further study. The study has been completed by consultant and, in accordance with state laws, Council must again adopt a resolution of intention to vacate the subject portion of right-of-way, setting a public hearing to consider the matter. • RECOMMENDATION: That Council adopt the subject resolution of intention and set a public hearing for November 3, 1987, at 4:00 p.m. in the Council Chambers. BOARDS/COMMISSIONS RECOMMENDATION: Nat applicable. DISCUSSION: Mr. William Perkins, owner of the property at 1550 Broadway, submitted an application to this department requesting that the City vacate a portion of Broadway right-of-way along the frontages of his property and the property to the north. (Lots 2 and 3 of Starfire Sports Subdivision, Map No. 8017, recorded September 11, 1974.} The reason given for the request is that his property is sub-standard in terms of parking capacity. In order for the applicant to fully use the lot in .accordance with the zoning, additional parking area is necessary. Presently, there is a one-way travel lane aligned with Silvas Street (see Exhibit "B"), a north-south minor street which extends south from Anita Street to Main Street, approximately 1,400 feet in length. It has been determined that this travel lane is unnecessary and the deletion would not cause a hazardous situation at the intersection. The Planning Department has been contacted regarding this matter and it has no objections to the proposed vacation. • • Page 2. Item 10 Heeting Date 10/13/87 We have notified all utility companies who may have facilities in the affected right-of-way. We will reserve easen-ents far those objecting to the vacation because of their existing facilities. We have also noticed all property owners along the southerly portion of Silvas Street from Anita Street to Hain Street. In accordance with Subsection 8320 of the California Streets and Highways Code, the City Council must adopt a Resolution of Intention to vacate right-of-way and the resolution must include the following: 1. A declaration of the intention of the legislative body to vacate; 2. A statement that the vacation proceeding is conducted under Chapter 3 of the Streets and Highways Code; 3. A description of the general location and extent of the street being vacated with reference to a map or plan on file in the office of the local agency; 4. The date, hour and place for hearing all persons interested in the proposed vacation. • A condition of approval of the street vacation will be that the applicant shall bear the cost of the engineering and construction to modify the northwest corner to accommodate right-turn traffic. This will include increasing the curb return radius to 35 feet which necessitates relocation of a signal standard and possible relocation of a 3'x5' SDG&E vault. The applicant has been advised of these requirements. There is a transparency and slides available far Council viewing. FISCAL IliPACT: A minimal decrease in street maintenance costs.
