Permit No. 026 for the Demolition of Structures at 350-368 Bay
Boulevard

The project proposal consists of demolition of existing structures and
foundations on approximately 2.6 acres of property located at 350-368 Bay
Boulevard owned by the Redevelopment Agency. The project has been approved by
the Agency and bids for the work have been accepted.
Negative Declaration IS-87-13 has been issued for the project. A demolition
permit and Coastal Development Permit are required prior to the start of work.
RECOMMENDATION: That the City Council conduct a public hearing and adopt
• the attached resolution:
1. Adopting Negative Declaration IS-87-13; and
2. Finding that the proposed project is consistent with the policies of the
certified Chula Vista Local Coastal Program; and
3. Approving Coastal Development Permit No. 026 subject to conditions listed
in said permit.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The site is located in the Chula Vista Bayfront Redevelopment Project.
Current land uses on the subject property are:
350 Bay Blvd. - A new and used auto dismantling business. It has two
corrugated metal buildings with small wooden sheds.
360 Bay Blvd. - A used vehicle dismantling business. Its two buildings, one a
corrugated metal shed and the other a three-room wood and stucco office and
shed, are joined.
364 Bay Blvd. - A large appliance repair and resale business. The three-room
• wood and stucco building serves as a shop and office.

368 Bay Blvd. - An appliance and vehicle service and supply business. Its
• two-room shop and storefront building is made of wood and stucco. The
five-room house west of the business is made of wood and stucco.
The existing uses on the project site are remainders of earlier prevailing
land uses allowed in the general industrial zone. Demolition of existing
buildings will provide developable land area for future users that are
currently consistent with the Industrial Business Park designation within the
LCP. No new development is proposed at this time.
Since the Bay Boulevard properties have been used for auto dismantling,
vehicle related materials such as oil and radiator fluid have been present on
the site. Operators of the former businesses have reported that oil and other
potentially toxic substances have been collected in 55 gallon drums and sent
off-site for disposal. However, there is some evidence that these substances
have seeped on the surface soils.
Because of the developed nature of the site, there are no biological nor
archaeological resources present. Also, no substantial geological hazards are
known to exist i n the vicinity of the project, but expansive soi 1 s are known
to be present in the general area.
The site is not located directly adjacent to any sensitive wetlands, but
surface drainage follows a course toward the southwest into an existing
drainage facility through the F/G Street Marsh. The site does not provide
access to the San Diego Bay or related water recreational areas.
• Conditions
1. Due to the type of activities formerly conducted on-site, there is a
potential for the presence of contaminated soils. Therefore, testing of
soils by a qualified toxic waste specialist shall be required and a report
of findings submitted to the property owner and appropriate City
department. If toxic materials are found to be present, recommendations
of the toxic specialist or reasonable alternatives shall be implemented to
remove or neutralize the substance present to result in a "clean" site
void of related hazards.
If significant disturbance of soils is required to achieve the site
"clean-up", all reasonable methods of controlling siltation and down
stream movernent of potentially hazardous materials shall be incorporated
into the project.
2. The applicant shall adhere to all development regulations set forth in the
certified Chula Vista Local Coastal Program and associated documents.
3. Following on-site earthwork the site shall be graded to drain into
existing public drainage facilities. Since the site will not be developed
immediately following demolition, special care shall be taken to ensure
that the project complies with Section 19.87.07 Grading and Drainage
requirements in the LCP.

Findings
• Based on the following findings , the proposed demolition project and
removal of associated debris, subject to conditions, is found to be consistent
with the policies of the Chula Vista Bayfront Local Coastal Program.
1. The demolition of existing structures and debris located on site will
remove uses currently inconsistent with the certified LCP and will
facilitate the construction of allowable land uses.
2. Grading following the demolition and debris removal shall be conducted in
accordance with grading regulations set forth in the certified LCP and
related documents intended to minimize the potential for siltation. In
addition, testing for contaminated soils is required and, if found, the
site shall be cleaned of all hazardous substances. This requirement will
remove the potential for such substances to move off-site with surface
run-off.
3. The Statewide and Regional Interpretive Guidelines have been reviewed and
the proposed demolition and debris removal has been found to be in
conformance with the Public Access and Public Recreational policies of
Chapter 3 of the Public Resources Code.

A. Project Setting
The project is located on the west side of Say Boulevard within ttre
Coastal Zone, the Bayfront Specific Plan and the Bayfront Redevelopment
District. Land uses on the subject property is as follows:
350 Bay Blvd. - Jackson's Imports is a new and used auto dismantling
business. It has 2 corrugated metal buildings with small wooden sheds on
the west end of the west building.
360 Bay Blvd. - A & R Used Truck Parts is a used vehicle dismantling
business. Its two buildings, one a corrugated metal shed and the other a
three-room wood and stucco office and shed, are joined.
• 364 Bay Blvd. - "Q-T Miscellaneous" is a large appliances repair and
resale business. The three-room wood and stucco building serves as a shop
and office.
368 Bay Blvd. - San Diego Purnp and Compressor Supply is an appliance and
vei~icle service and supply business. Its two-room shop and storefront
building is made of wood and stucco. The five-room house west of the
business is made of wood and stucco.
Adjoining land uses include:
North: Thermo King is a refrigeration business with an approximately
3,500 sq. ft. office and shop.
Souti~: Lawless Detroit Diesel is a machinery manufacturing company with
a building of approximately 33,000 sq. ft.
East: Bay Blvd. is the east boundary and the I-5 freeway is directly
east of Bay Blvd.
best: The San Diego and Arizona Railroad right-of-way is the west

2. During the grading of the site, any toxic materials will, depending
on their characteristics be disposed of on site, transported to a
local land fill or be transported to a Class I land fill site.
F. Findings of Insignificant Impact
1. There are no natural nor cultural resources or hazards present which
would be substantially effected by tiie change in ownership or by the
demolition of the existing.

2. The implementation of the project is a step in the overall attainment
of the long-term goals of the Ciiula Vista Bayfront Specific
Plan/Local Coastal Program. The project will result in the short
term change of ownership to tiie Redevelopment Agency and clearing of
the site. On a long-term basis, the project will assist in the
attainment of the long-term goals of the Bayfront Plant by
consolidating properties and attaining higher development regulations.
3. The cumulative impacts of this proposal are not considerable because
there are no significant impacts which could be considered cumulative
in nature or some effects such as public facility impacts will be an
improvement over the existing condition.
4. Through the removal of the existing land uses, there will be an
overall long-term improvement in the land use pattern and the human
environment.

CONDITIONS OF APPROVAL
1. Due to the type of activities formerly conducted on-site,
