On August 5, 1987, the Shell Oil service station in the Terra Nova Plaza was
cited by the State of California for sign violations. The State requires that
persons selling motor vehicle fuel to the public shall provide advertising
mediums which advertise the prices of the three major grades of fuel offered
for sale. These advertising mediums shall be clearly visible from the street
or highway adjacent to the premises.
The Environmental Review Coordinator has determined that the proposed urgency
ordinance is exempt from environmental review under Section 4.3 (Class II) of
the Environmental Review Procedures of the City of Chula Vista.
RECOMMENDATION: That Council adopt a motion to enact an interim urgency
ordinance amending Title 19 of the Plunicipal Code to exempt service stations
which are located along scenic corridors from State-mandated service station
price sign locational requirements. The amended text reads as shown on
Exhibit "A" attached hereto which specifically exempts the Shell Oil service
• station located within the Terra Nova Plaza.
DISCUSSION:
Service stations located along scenic corridors may be exempted from State
price sign regulations by local ordinance subject to identifying specific
geographical areas. A Shell Oil service station, which was cited by the State
for failing to display price signs along East "H" Street, is located along a
designated scenic corridor and within the Terra Nova Plaza. Service station
price signs are oriented not toward the public street but rather toward the
interior of the Plaza, in compliance with the City of Chula Vista sign
regulations and the Terra Nova Precise Plan. Motorists entering the center to
access the Shel l Station can readily view these price signs prior to entering
the service station.
There are alternate locations for display of price signs along designated
scenic highways, and opportunities for staff review and approval of sign types
and location through the precise plan, CUP process and existing sign
regulations. Therefore, it appears appropriate to provide an exemption in
these cases from the locational criteria of State price sign regulations. The
proposed amendment provides for exempting service station price signs from
State-required visibility along scenic routes with the Terra Nova Plaza Shell
Oil service station site specifically identified.
Under the provisions of Title 19, this ordinance shall be in effect for (90)
days during which time a hearing will be held by the Planning Commission for
• the permanent ordinance.
