The District has prepared a new document extending the easement to August 31, 1992. RECOMMENDATION: That Council adopt a resolution accepting the new easement for Tidelands Avenue and direct the Mayor to sign the easement in the City's behalf. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The Unified Port District initially granted the Tidelands Avenue easement to the City in 1967. A continuation of the temporary right-of-way expires on August 31, 1987, and the District has prepared a new easement which will be effective through August 31, 1992, once it has been accepted by the City Council and approved by the Board of Port Commissioners. The conditions of the easement included in the earlier documents have been repeated in this grant of easement. They provide, in general, that the District will not incur any liabilities to any outside party or the City as a result of this easement. The location of the easement coincides with the existing roadway. It is anticipated that this street will be replaced by Marina Parkway, if the Midbayfront Subdivision is constructed. The City has reached a tentative agreement regarding the alignment of Marina Parkway with the Port District. The easement and a plat are enclosed as exhibits to this report. FISCAL IMPACT: Continuing maintenance of the street and the eventual removal of the street surface when it is no longer used or needed will be required. Staff agrees in concept with the items enumerated. In addition, staff feels that all utilities in the portion of "G" Street east of relocated • Marina Parkway should be relocated to the new right-of-way so as not to encumber the vacated tidelands property. Dedication of the presently undedicated portion of former Tidelands Avenue right-of-way south to J Street will be subject to approval by the Board of Port Commissioners. Wilbur, Chief Engineer CNULA VISTA BAYFRONT SUBDIVISION (CVT 87-4) On March 19, 1987, the City Council denied approval of the Tentative Map for Chula Vista Tract 87-4 (Chula Vista Bayfront Subdivision). The proposed subdivision is located west of Bay Blvd. and north of the westerly extension of • "G" Street in Chula Vista. The main reason for the denial was that the Tentative Map was found to not be in compliance with the approved Local Coastal Program (L.C.P). It is expected that the developers will resubmit the Tentative Map after amending the L.C.P. During the past few months, there have been discussions between City staff and Port District staff regarding the alignment of the southerly extension of the proposed Marina Parkway and its connection to the existing Tidelands Avenue within the Port District jurisdiction. The purpose of this letter is to document the tentative agreements reached in those discussions. 1. Marina Parkway will be designed for 40 mph with centerline radii of 600 feet. The horizontal alignment will be approximately as shown in exhibit "A" (attached). _ 2. The right of way should match that of Marina Parkway within the. subdivision (95 feet) and should be dedicated to the City as a public street. 3. In conjunction with the dedication of l~larina Parkway right of way,- City staff will support a request by the Port District for vacation of existing right of way for Tidelands Avenue which is in excess of that required for Marina Parkway (reserving easements for any. existing utilities). 4. Wilbur - 2 - April 3, 1987 • 5. Plans for Marina Parkway will be prepared by private engineers on Chula Vista standard plan sheets and will be signed by the City Engineer. Plans will be submitted to the Port District for review and approval prior to signature by the City Engineer. The City of Chula Yista will inspect all work. 6. An issue that was never discussed, but will need to be addressed in conjunction with dedication of Marina Parkway is the dedication of the remainder of Tidelands Avenue to "J" Street (beyond that described in Item 2 above). I would appreciate a written acknowledgement of concurrence or disagreement with the above discussed items. sties'`.
