AMENDING CHAPTER 15.06 OF THE CHULA VISTA
MUNICIPAL CODE, ADl\lINISTRATTVE PROVISIONS FOR
THE TECHNICAL BUILDING CODES
The City Council of the City of Chula Vista does ordain as follows:
SECTION 1 That certain Sections of Chapter 15.06, Administrative Provisions for the
Technical Building Codes. are amended to read as follows:
Section 15.06.001 Purpose
Section 15.06.001. Purpose. is hereby amended and shall read as follows:
The purpose of this chapter is to establish rules and regulations for the administration and
enforcement of certain technical codes, which codes are identified in and adopted in the manner
indicated in Chapters 15.08, 15.09, 15.10. 15.12, 15.16, 15.24,15.26 and 15.28, and associated
with site preparation and construction, location, alteration, moving, demolition, repair. use and
occupancy of buildings, structures and building service equipment.
Section 15.06.015 Definitions
The definition of Building Official in Section 15.06.015 is hereby amended and shall read
as follows:
"Building Oftlcial" means the officer or other designated authority of the City of Chula
Vista charged with the administration and enforcement of this codc and the technical codes, or
duly authorized representative.
SECTION 11. SCOPE OF AMENDMENT
This Amendment changes only those Sections specifically identificd in Section t, above. No
other changes to Chapter 15.06 are contemplated or intendcd by this Ordinance. The balance of
Chapter 15.06 shall remain unchanged and continue in full force and effect.
SECTION Ill. EFFECTIVE DATE.
This ordinance will take effect and be in force thirty days after final passage but not before
January 1, 2011.

occupancy, use, height, and area of all buildings and structures in the City, excepting such
portions as Clfe hereinafter deleted, modified, or amended. Municipal Code Chapter 15.06

Subsection 903.2 of the California Building Code is hereby amended, as it applies
in Chula Vista, by the addition of the following:
In every building regardless of occupancy, group or type of construction,
when such building is more than forty feet or four stories or more in height.
15.08.100 Suhseetion 1509.6 is added to Section 1509 to require equipment
enclosures on roofs.
Subsection 1509.6 is hereby added to Section 1509 of the California Building Code,
as it applies in Chula Vista, and shall read as follows:
Subsection 1509.6 Equipment Enclosure. Operating equipment, including
piping and ducts located on the roof of a building, shall be shielded from
view from public thoroughfares, and private and public parking lots.
Equipment enclosures shall not be constructed so as to trap flammable or
com bustiblc vapors.
Exception: Solar collectors. Does not include structural supporting
members.

FINDINGS AND DECLARA nON
The City Council of the City of Chula Vista specifically and expressly finds and declares
that each of the amendments noted above to the 2010 Edition of the California Building
Code is necessary due to local climatic, geological and topographical conditions.

Section 15.12.010 California Green Building Standards Code Subsection 102.4
Subsection 102.4 is hereby added to Section 102 of the California Green Building
Standards Code. as it applies in Chula Vista, and shall read as follows:
102.4 Consultanr Services. The Buih.ling Official may require the applicant to retain the
services of a consultant having expertise in Green Building and/or energy efficiency techniques
to review and evaluate complex systems and/or alternate methods or materials of construction
and provide recommendations as to compliance with the requirements of this code. The cost of
such consultant shall be paid by the applicant.

15.24.035 I'reviously used materials.
Previously used materials shall not be reused in any work without approval by the Building
Official.
15.24.045 Distribution panels - Separate required when.
Each store in a store building, each flat in a flat building, and each building used as a dwelling
shall be so wired that each store) apartment, ilat or dwelling shall have separate lighting amllor
power distribution panels. Such panels shall not serve other portions of the building. Hotels,

motels, hOlel apartments and similar types of buildings may be wired from one or more
distribution panels.
15.24.050 Circuit cards to be posted when.
When requested by the Building Official, a complete schedule of circuits showing the numher,
kind and capacity of each outlet on each circuit shall be posted on each job prior to rough
inspection.
15.24.1l55 Electric fences - Defined - Prohibited.
A. As used herein, the term "electric fence" includes all fences which in any way use electrical
energy as an additional deterrent or have wires charged with electricity which are !lot covered
with adequate insulation to protect persons and animals coming in contact therewith.
B. No electric fence may be constructed, maintained or operated within the City.
J 5.24.060 Phase arrangement - Amended.
Scction 408.3(E) of the California Electrical Code is hereby amended to read:
Phase Arrangement. The phase arrangement on three-phase buses shall be A, B, C from
front to back, top to bottom, or lcft to right, as viewed from the front of the switchboard
or panclboard. The C phase shall be that phase having the higher voltage ground On three-
phase, four-wire delta-connected systems. Other busbar arrangcments may be permitted
for additions to existing installations and shall be marked.
15.24.065 Photovoltaic Pre-wiring Requirements.
All new residential units shall includc electrical conduit specifically designed lo allow the
later installation of a photovoltaic CPV) system which utilizes solar energy as a means to provide
electricity. No building permit shall be issued unless the requirements of this section and the
Chula Vista Photovoltaic Pre-Wiring Installation Requirements are incorporated into the
approved building plans.
The provisions of this chapter can be modified or waived when it can be satisfactorily
demonstrated to the building official that the requirements of this section are impractical due to
shading, building orientation, construction constraints or configuration of the parcel.

installation of a system which utilizes solar energy as the primary means of heating domestic
potable water. No building permit shall be issued unless the requirements of this section and the
Chula Vista Solar Water Heater Pre-Plumbing Installation Requirements are incorporated into
the approved building plans.
The provisions of this chapter can be modified or waived when it can be satisfactorily
demonstrated to the building .offlcial that the requirements of this section are impractical due to
shading, building orientation, construction constraints or configuration of the parceL

15.36.015 Definitions.
Chapter 2 Definitions - Section 202 of the F,re Code Portion of the California
Building Standards Code is hereby revised to include the following definitions:
"Chief ofth~ Bureau QfFire Prevention" means Fire Marshal.
"Fire Department" ffit:ans any regularly organized fire department, fire protection district,

Fire Company regularly charged with the responsibility of providing fire prot.ection to the
jurisdiction.

"Fire Authority Having Jurisdiction (FAl-UP means the designated entity providing
~nforc:emcnt of fire regulations as they relate to planning, construction and devetopment.
This entity may also provide fire suppression and other emergency services.
"Fire Hazard" means anything that increases or could cause an incrc::!.se of the hJ.Zard or
menace of fire to a greater degree than custom:lrily recognized as nonnal by persons in
the public service regularly engaged in preventing, suppressing or extinguishing fire or
any thing or act which could obstruct, delay. hinder or interfere with the ope:rations of the
fire department or egress of occupants in the event of fire.
"Fire Service Features" is 3 general term inclusive of all other terms such as driveway,
fire lane, public street, private street, parking lot, lane and access roadway.
This Section 15.36.015 amends Section 202 of the Fire Code Portion of
the California Building Standards Code only by adding those ddinitions
specifically identified in herein. No other changes to Section 202 of the Fire
Code Portion of the California Building Standards Coue are contemplated or
intended, and the balance of the definitions therein shall temain unchanged and
continue in full force and effect
15.36.020 Solar PhotovoItaic Installation Guidelines.
Chapter I Scope and Administration - Subsection 1.1 S 1 Solar Photovoltaic
Installation Guidelines is hereby auded to the Fire Code portion of the California Building
Standards Code to read as follows:
Subsection I.I.S.l Solar Photovoltaic lnstallation Guidelines. With respect to Solar
Photovoltaic installations, the provisions contained in the California Department of
Forestry and Fire Protection-Office of the State Fire Marshal's Solar Photovoltaic
Installation Guidelines, as dated April 22, 2008, are hereby adopted in acc.ordance with
and pursuant to Subsection I. J.5, and shall be used for the design and insta1l3tion of solar
phOlovoltaic systclns.
\15.36.025 Operational permit for Christmas tree lots.
Chapter 1 Scope and Administration - Subsection 105.6.48 Christmas tree lots is
hereby added to the Fire Code portion of the California Building Standards Coue to read as
follows:
Subsection 105.6.48 Christmas tree lots. An operational permit is required to operate a
Christmas tree lot with or without tlame~proofing services.

111.4 Failure to comply. Any person who shall continue any work after having been serVt'd
with a stop work order, except such work as that person is directed to perform to remove a
violation ur unsafe condition, shall be subject to a fme of not less thun $250.00 dollars or
more than $1.000 dollars.
15.36,050 Fire hydrant systems -- Where required.
Chapter 5 Fire Service Features - Subsection 508.5.1 Fire hydrant systems -- Where
required of the Fire Code portion of the California Building Standards Code is hereby
revised to read as follows:
Subsection 508.5.1 Where required. Where a portton of a facility or building hereafter
constructed or moved into or withjn the jurisdiction is more than 150 fed from a hydrant
on a fire apparatus access road, as measured by an approved roure around the exterior of
the facility or building, on-site fire hydrants and mains shall be provided where required
by the nre code officiaL
Exceptions: 1. For Group R-3 and Group U occupancies, the distance requirement shall be
250 feet. In Group R-3 and Group U occupancies. the dIstance requirement shall be not
more than 600 fed when equipped throughout with an approved automatic sprinkler
system installed in accordance with this code.
15.36.055 Fire hydrant spacing.
Chapter 5 Fire Service Features - Subsection 507.5.1.1 Fire hydrant spacing is
hereby added to the Fire Code portion of the California Building Standards Code to read as
follows:
Subsection 507.5.1.1' Water supplies and fire hydrants. [n multi-family zones and in
commercial and industrial zones, fire hydrants shall be installed at intersections, at the
beginning radius of cul.de-sacs. and every 300 f~et (on-center) offire access roadways,
regardless of parcel size. In single-family zones, fire hydrant5 shall be installed every 500
feet (on-center).

Chapter 8 Interior Finish, Decorative Materials, 3Ild Furnishing -- Subsection
807.4.3.2 Artwork of thc Fire Code portion of the California Building Standards Code is
hereby revised to read as follows;
Subsection 807.4.3.2. Artwork. Artwork and teaching materials shall be limited on the wnlls of
corridors and classrooms to not ll10re than 20 percent ofrhe wall area in non-sprinklered buildings
and 50 percent in sprinklered buildings.
SECTION II. FINDiNGS AND DECLARATiON
The City Council of the City of Chula Vista specifically and expressly finds and declares
that each of the additions and amendments noted above to the 2010 Edition of the
California Fire Code is necessary due to local climatic, geological and topographical
conditions.
SECTION TIT. EFFECTIVE DATE.
This ordinance will take effect and be in force thirty days after final passage but not before
January 1, 2011.
