AN ORDINANCE OF THE CITY OF CI-IULA VISTA AMENDING CHAPTER 15.06 OF THE CHULA VISTA MUNICIPAL CODE, ADl\lINISTRATTVE PROVISIONS FOR THE TECHNICAL BUILDING CODES The City Council of the City of Chula Vista does ordain as follows: SECTION 1 That certain Sections of Chapter 15.06, Administrative Provisions for the Technical Building Codes. are amended to read as follows: Section 15.06.001 Purpose Section 15.06.001. Purpose. is hereby amended and shall read as follows: The purpose of this chapter is to establish rules and regulations for the administration and enforcement of certain technical codes, which codes are identified in and adopted in the manner indicated in Chapters 15.08, 15.09, 15.10. 15.12, 15.16, 15.24,15.26 and 15.28, and associated with site preparation and construction, location, alteration, moving, demolition, repair. use and occupancy of buildings, structures and building service equipment. Section 15.06.015 Definitions The definition of Building Official in Section 15.06.015 is hereby amended and shall read as follows: "Building Oftlcial" means the officer or other designated authority of the City of Chula Vista charged with the administration and enforcement of this codc and the technical codes, or duly authorized representative. SECTION 11. SCOPE OF AMENDMENT This Amendment changes only those Sections specifically identificd in Section t, above. No other changes to Chapter 15.06 are contemplated or intendcd by this Ordinance. The balance of Chapter 15.06 shall remain unchanged and continue in full force and effect. SECTION Ill. EFFECTIVE DATE. This ordinance will take effect and be in force thirty days after final passage but not before January 1, 2011. Conv,ersion. of existing Group R occupancies to offices. 15.08.080 Subsection 903.2 is amended to require installation of automatic fire- extinguishing system in buildings greater than certain height. 3~-1 Ordinance No. Page 2 Subsection 903.2 of the California Building Code is hereby amended, as it applies in Chula Vista, by the addition of the following: In every building regardless of occupancy, group or type of construction, when such building is more than forty feet or four stories or more in height. 15.08.100 Suhseetion 1509.6 is added to Section 1509 to require equipment enclosures on roofs. Subsection 1509.6 is hereby added to Section 1509 of the California Building Code, as it applies in Chula Vista, and shall read as follows: Subsection 1509.6 Equipment Enclosure. Operating equipment, including piping and ducts located on the roof of a building, shall be shielded from view from public thoroughfares, and private and public parking lots. Equipment enclosures shall not be constructed so as to trap flammable or com bustiblc vapors. Exception: Solar collectors. Does not include structural supporting members. SECTION II FINDINGS AND DECLARA nON The City Council of the City of Chula Vista specifically and expressly finds and declares that each of the amendments noted above to the 2010 Edition of the California Building Code is necessary due to local climatic, geological and topographical conditions. When requested by the Building Official, a complete schedule of circuits showing the numher, kind and capacity of each outlet on each circuit shall be posted on each job prior to rough inspection. 15.24.1l55 Electric fences - Defined - Prohibited. A. As used herein, the term "electric fence" includes all fences which in any way use electrical energy as an additional deterrent or have wires charged with electricity which are !lot covered with adequate insulation to protect persons and animals coming in contact therewith. B. No electric fence may be constructed, maintained or operated within the City. J 5.24.060 Phase arrangement - Amended. Scction 408.3(E) of the California Electrical Code is hereby amended to read: Phase Arrangement. The phase arrangement on three-phase buses shall be A, B, C from front to back, top to bottom, or lcft to right, as viewed from the front of the switchboard or panclboard. The C phase shall be that phase having the higher voltage ground On three- phase, four-wire delta-connected systems. Other busbar arrangcments may be permitted for additions to existing installations and shall be marked. 15.24.065 Photovoltaic Pre-wiring Requirements. All new residential units shall includc electrical conduit specifically designed lo allow the later installation of a photovoltaic CPV) system which utilizes solar energy as a means to provide electricity. No building permit shall be issued unless the requirements of this section and the Chula Vista Photovoltaic Pre-Wiring Installation Requirements are incorporated into the approved building plans. The provisions of this chapter can be modified or waived when it can be satisfactorily demonstrated to the building official that the requirements of this section are impractical due to shading, building orientation, construction constraints or configuration of the parcel. Chapter 2 Definitions - Section 202 of the F,re Code Portion of the California Building Standards Code is hereby revised to include the following definitions: "Chief ofth~ Bureau QfFire Prevention" means Fire Marshal. With respect to Solar Photovoltaic installations, the provisions contained in the California Department of Forestry and Fire Protection-Office of the State Fire Marshal's Solar Photovoltaic Installation Guidelines, as dated April 22, 2008, are hereby adopted in acc.ordance with and pursuant to Subsection I. J.5, and shall be used for the design and insta1l3tion of solar phOlovoltaic systclns. \15.36.025 Operational permit for Christmas tree lots. Chapter 1 Scope and Administration - Subsection 105.6.48 Christmas tree lots is hereby added to the Fire Code portion of the California Building Standards Coue to read as follows: Subsection 105.6.48 Christmas tree lots. Chapter 5 Fire Service Features - Subsection 508.5.1 Fire hydrant systems -- Where required of the Fire Code portion of the California Building Standards Code is hereby revised to read as follows: Subsection 508.5.1 Where required. Where a portton of a facility or building hereafter constructed or moved into or withjn the jurisdiction is more than 150 fed from a hydrant on a fire apparatus access road, as measured by an approved roure around the exterior of the facility or building, on-site fire hydrants and mains shall be provided where required by the nre code officiaL Exceptions: 1. For Group R-3 and Group U occupancies, the distance requirement shall be 250 feet. In Group R-3 and Group U occupancies. the dIstance requirement shall be not more than 600 fed when equipped throughout with an approved automatic sprinkler system installed in accordance with this code. 15.36.055 Fire hydrant spacing. Chapter 5 Fire Service Features - Subsection 507.5.1.1 Fire hydrant spacing is hereby added to the Fire Code portion of the California Building Standards Code to read as follows: Subsection 507.5.1.1' Water supplies and fire hydrants. [n multi-family zones and in commercial and industrial zones, fire hydrants shall be installed at intersections, at the beginning radius of cul.de-sacs. and every 300 f~et (on-center) offire access roadways, regardless of parcel size. SECTION II. FINDiNGS AND DECLARATiON The City Council of the City of Chula Vista specifically and expressly finds and declares that each of the additions and amendments noted above to the 2010 Edition of the California Fire Code is necessary due to local climatic, geological and topographical conditions.
