SUMMARY
On December IS, 200'!, by Resolution 2009-286, RMC Water and Environment (RMC) was
retamed by the City of Chula Vista and Otay Water District (OWD) to prepare a Wastewater
Reclamation Facility Feasibility Study. As part of the joint participation, Otay will bear the cost
of 50% of the consultant services on a reimbursement basis as invoices are submitted, RMC
agreed to prepare the study for a contracted amount of$199,990,
While reviewing the feasibility study, City and OWD staff requested that RMC perfom1 some
additional tasks identified in the Amendmcnt. Upon negotiating, RMC requested $40,814 for
said amendment. As with the original contract per Resolution No, 2009-286, and the agreement
between OWD and Chula Vista per Resolution No, 2009-207, OWD wi11 bear 50% of cost of the
additional tasks,
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the Califomia Environmental Quality Act (CEQA) and has determined that there is no possibility
that the activity may have significant effect on the environment; therefore, pursuant to Section
1500l(h)(3) (General Rule) of the State CEQA Guidelines the activity is not subject to CEQA
Although envirollli1cntal review is not necessary at this time, additional environmental review
will be required as applicable pnor to the approval of any future project specific development
entitlements including, but not limited to, site development plans, building permits, land
development pem1its, and conditional use permits,

DISCUSSiON
On September 1. 2009, per Resolution 2009-207, the City Council approved an agreement
between thc City of Chula Vista and Otay Water Distnct for joint participation to prepare a
Wastewater Reclamation Facility Feasibility Study.
Subsequently, on December I), 2009, by Resolution 2009-286, RMC Water and Environment
Consultant (RMC) was retained by the City of Chula Vista and Otay Water District to prepare a
Wastewater Reclamation Facility Feasibility Study. The purpose of the study is to analyze
various options available to meet the City of Chula Vista's long-term sewer treatment capacity
needs. As a part of the study, RMC is required to evaluate the option of constructing a
wastewater treatment facility in Chula Vista in comparison to the option of purchasing additional
treatment capacity rights in the Metropolitan Wastewater Department (Metro) of the City of San
Dicgo.
In an effort to educate and encomage the community to get involved in the feasibility study,
RMC organized a trip inviting the City Council and community leaders to visit the City of
Corona Membrane Bioreactor (MBR) plant, and the Lee Lake Water District Sequencing Batch
Reactor (SBR) Wastewater Reclamation Plant. MBR and SBR plants are an attractive option for
the City's situation primarily because they occupy a relatively small footprint, they are relatively
easy to operate, and they can be housed in any plausible buildmg that could easily blend in with
the smrounding area, and can be easily upsized to keep in step with the City's treatment needs.
The purpose of this visit was to introduce MBRP and SBRP and its environmental setting.
In addition, staff and OWD requested that RMC perfonn additional tasks that are not included in
the original contract including:
1. Engineering site evaluation:
In order to provide a comprehensive public outreach meeting, City staff performed an
internal site evaluation for eight potential treatment plant sites within the City of Chula
Vista. Subsequently, the City requested that RMC perform an Engineering Evaluation to
look for the feasibility of each of those eight sites from an engineering standpoint. RMC
will evaluate the eight sites based on four criteria-site size, wastewater availability,
pumping and piping. A technical memorandum will be submitted with the resnlts of the
analysis.
2. Evaluating a fourth treatment plant site:
The CLllTent scope of work includes the evaluation of three (3) treatment plant sites. After
receiving feedback from the public during the Public Outreach meeting that was held on
July 29, 2010, it was detemlined that a fourth site would require evaluation. As such,
RMC has been requested to prepare a conceptual site plan, a site specific cost estimate,
and compare the site to the other three sltes.

3. Provide information on possible funding sources for the project:
Acquisition of new wastewater capacity will require fUl1lling. There are potential funding
sources lor this project from both Federal and State sources that can reduce the cost to the
City. These funding sources generally consist of either grants or low interest loans. RMC
will identify funding sources, the potential amounts, funding criteria as well as funding
cycles, award feasibility and net impact to the City.
4. Performed evaluation of the impact of the proposed Apex power plant cooling water
blow-down discharge to the sewer upstream of a Chula Vista recycled water plant.
On September 17, 2010, while RMC prepared a draft of the feasibility study, staff
requested that RMC add this task to the feasibility study. RMC requested $9,600 tor
completing this task. Unfortunately, on October, 28, 2010, the City was informed that
Apex Power Plant decided to no longer pursue the power plant project. Consequently,
staff directed RLV!C to cease all work on this task. RMC requested a compensation of
$2,941 for the partial work that was already performed on this task.
The cost tor completing the additional tasks and the public outreach effort is $40,814. OWD has
agreed to pay for 50% of the cost of this amendment excluding the MBR and SBR wastewater
treatment plant public outreach tour provided at the request of the City. The City already
lIlVoiced OWD for the cost of 50% ($86,900) of some of the consultant services.
Staff anticipates that RlvlC will complete the feasibility study in December of 201 O.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site
specific and consequently the 500 toot mle found in Califomia Code of Regulations Section
18704.2\a)( 1) is not applicable to this deciSion.
CURRENT YEAR FISCAL IMPACT
There is no impact to the General Fund for this Amendment. Funding for this project was
appropriated during the adoption of the Capital Improvement Budget, capital improvement
project SW258 "Sewer Capacity Analysis". Council's approval will appropriate an additional
$40,814 to SW258 for the new tasks outlined above from the available balance of the Trunk
Sewer Fund which shall be reimbursed by Otay for 50% (excluding MBR Plant Tour).
ONGOING FISCAL IMPACT
There is no ongoing fiscal impact associated with funding the feasibility study.
Recommendations resulting from the study will be used to resolve sewer treatment capacity
Issues.

WHEREAS, the economy, employment, and quality of life within the San Diego
County region is dependent on a reliable and affordable water supply; and,
WHEREAS, additional wastewater collection disposal capacity can be obtained
by Chula Vista through the construction of a wastewater reclamation facility within the
City of Chula Vista or by acquiring additional sewage disposal capacity from
Metropolitan Wastewater Department (Metro) of the City of San Diego; and,
WHEREAS, the current Otay Water District long-term projected recycled water
demand established the need for increased recycled water supply to satisfy the market
demand; and,
WHEREAS, on December IS, 2009, by Resolution 2009-286, RMC Water and
Environment (RMC) was retained by the City of Chula Vista and Otay Water District to
prepare a Wastewater Reclamation Facility Feasibility Study; and,
WHEREAS, while reviewing the feasibility study, City and OWD staff requested
that R.J\.1C perform some additional tasks. Upon negotiating, RMC requested $40,814 for
said amendment; and,
WHEREAS, the current agreement between OWD and Chula Vista per
Resolution No. 2009-207, dictates that OWD shall bear 50% of cost of the additional
tasks; and,
WHEREAS, RMC warrants and represents that they are experienced and staffed
in a manner such that they are and can deliver the services required.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Chula Vista does hereby approve the first amendment to the agreement with RMC Water
and Environment in the amount $40,814, amend the FY2010-ll CIP Program and
appropriate additional funds in the amount of $40,814 to existing capita! improvement
project SW258 from the available balance of the trunk sewer fund.

TO THE
AGREEMENT BETWEEN

FOR PROVIDING CONSULTANT SERVICES NEEDED TO FACILITATE THE CITY OF
CHULA VISTA ACQUISITION OF ADDITIONAL WASTEWATER DISPOSAL CAPACITY
This first amendment is effective November 24, 2010 by and between the City ofChula
Vista (City) and RMC Water and Environment (Consultant) with reference to the following:
WHEREAS, City and Consultant entered into an agreement (Original Agreement) on
December IS, 2010, by Resolution 2009-286, tor consultant services associated with obtaining
additional wastewater disposal capacity; and
WHEREAS, the Original Agreement required the Consultant to perform certain
feasibility studies and analyses related to the construction of wastewater reclamation facilities at
ditferent sites within the City ofChula Vista: and
WHEREAS, in furtherance of the City's goal of obtaining additional wastewater
capacity, City requires Consultant to perform other tasks than those specifically identified in the
Original Agreement.
NOW, THEREFORE, for mutual consideration, the sufficiency of which is hereby
acknowledged, the Parties agree to amend Original Agreement as follows:
I. The tasks identified in the document entitled "Addendum to Exhibit A", attached hereto and
incorporated herein by reference, shall be appended to the Scope of Work and associated task
list included in the Original Agreement.
2. Section 13(C)(1)(a) shall be added to Page 25 and read:
Notwithstanding the foregoing, Consultant shall perform the tasks in the Addendum to
Exhibit "A" for a fee not to exceed forty thousand eight hundred fourteen dollars
($40,814), including all Materials and other "reimbursable items" ("Maximum
Compensation for Additional Tasks")
3. All other terms and conditions of the Original Agreement remain unchanged.

Dear Roberto Yano:
RMC is pleased to provide our proposal to provide additional work items requested by
the City for the Additional Waste Water Capacity Project.
1. Add a l'ourth treatment plaut site to our evaluatiou:
The currently scoped level of effort is based on the evaluation of three (3) treatment
plant sites. However after the site screening evaluation it was determined that a fourth
site would be beneficial to carry forward. For the fourth site we will prepare a
conceptual site plan, prepare a site specific cost estimate, and compare the site to the
other three sites. This work requires an addiiional48 hours of effort.
2. Provide information on funding sources for the project:

potential funding sources for this project from both federal and state sources that can
reduce the cost to the City, These funding sources generally consist of either grants or
low interest loans. We will identify potential funding sources, the potential amounts,
the requirement and conditions, and the impacts on cost to the City. This additional
work requires an additional 40 hours of effort.
3. Organize Visit to Treatment Plants Sites (SBR & MBR):
Public input and support are integral to the success of this project. Example MBR and
SBR Treatment Plants exist in Southern California. We will organize site tours of two
treatment plants, one SBR and one MBR, for City staff and the public to get a deeper
understanding for potential treatment plant types for the City ofChula Vista. We will
select potential treatment plants similar to what is being proposed in the study, send
them to the City for final selection/buy-offthen organize the travel, snacks and meals
for up to 30 attendees. Task will include scheduling tours with treatment plant
management, creating handouts for tour, procuring coach bus, breakfast, snacks,
drinks and lunch and leading plant tours. This additional work requires an additional
64 hours of effort.
4. Engineering Site Evaluation:
City staff performed their own internal Site Evaluation for eight potential treatment
plant sites WIthin the City of Chula Vista. The City requested that RMC perfOlm an
Engineering Evaluation to look for the feasibility of each site from an engineering
standpoint. We will evaluate eight sites based on five criteria-site size, wastewater
availability, pumping and piping. A technical memorandum will be submitted wiih

the results ofthe analysis. This additional work requires an additional 37 hours of effort.
5. Evaluate the impact of the proposed Apex power plant cooling water blow-down discharge to the
sewer upstream of a CV recycled water plant.
The City is considering a proposed "peaker" power plant by Apex which could discharge
cooling water blow-down into the sewer. This blow-down will be very high in salinity that
can adversely impact the suitability of recycled water to OWD if it is influent to the recycled
water treatment plant. The City is considering requiring Apex to discharge the blow-down
during short (3 hours) window during the late night/early morning period at which time the
recycled water plant would cease to draw water from the sewer until the salinity plume has
passed the point of sewer diversion. We will evaluate the management approaches to limit
the impact of the discharge including addition of equalization storage of raw sewage,
estimate the travel time and dissipation of the salinity plume, and instrumentation and control
strategies. The additional work requires and 48 hours of effort. NOTE: TASK WAS
CANCELLED ON 10/27/10 DUE TO CHANGE IN APEX LOCATION. TOTAL
SPENT ON THIS TASK WAS $2,941.
Additional Cost- The cost to our agreement shall be increased by: $40,814
