CHIEF OF POLICE ~ CITY MANAGERF 4/5THS VOTE: YES NO X SUBMITTED BY: REVIEWED BY: SUMMARY The Police Department was awarded $407,974 as part of Operation Stonegarden to conduct regional law enforcement operations to intercept terrorists and their weapons from coming across the United States Border. As part of this grant award, the Department was awarded funding for an armored tactical vehicle. Council accepted the funds via Council Resolution 2010-033. The Police Department is requesting waiving the competitive bidding process to purchase thc vehicle, and utilize the State of California Public Safety Procuremcnt Program (1122 Counterdrug Program) to purchase one Lenco BearCat to provide annored, quick tactical/extraction capabilities in the Southern San Diego region. ENVIRONM ENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defmcd under Section 15378 of the State CEQA Guidelines because it will not result in a physical. changc in the environment; therefore, pursuant to Section l5060(c)(3) of the State CEQA Guidclines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDA nON That Co uncil adopts the reso lution. 9-1 NOVEMBER 23,2010 Item q Page 2015 BOARDS/COMM ISSION RECOMMENDA nON Not Applicable DISCUSSION Since the events of September ii, 200], the interception of terrorists and their weapons attempting entry across the nation's borders has become the priority mission of the U.S. Department of Homeland Security. Grant funding via "Operation Stonegarden" has been awardcd to the San Diego County region to facilitatc regional partnerships and enhance border enforcement capabilities. In coordination with U.S. Customs and Border Protection (CBP) and grant administration by the County of San Diego, the Police Department has been participating in Operation Stonegarden since September 2008. The mission of Operation Stonegarden is to raise border security by increasing law enforcement presence along the border, intelligence/information sharing and communication. Participating agencies in this regional effort include the U.S. Customs and Border Protection (CBP), ]mmigration and Customs Enforcement (ICE), San Dicgo County Sheriffs Department, California Highway Patrol, California Fish and Game, San Diego County Probation Department and San Diego Harbor Police. The Chula Vista Police Department is in the unique position of being geographically located in close proximity to the border (5 miles) with three main north/south arteries traversing the city. As a result, multiple local and federal agencies frequently ask the Department for assistance and interdiction of both north and south bound traffic involved in border-related crimes including drug smuggling, human trafficking, and auto theft. The South Bay portion of San Diego Countyl has a (2008) population of over 522,000 persons, yet there is no regional asset capable of performing tactical emergency medical services or other activities in a lethal environment. The Chula Vista Police Department proposes to purchase an armored tactical rescue vehicle for use by South Bay jurisdictions for tactical operations, including EMSlrescues, group. evacuations of up to 20 persons from dangerous environments, rapid deployment of up to 15 fully equipped officers to incident scenes, and in other high-risk situations, particularly those associated with people and narcotics smuggling and border spill-over violence. Staff researched several armored tactical vehicles. During the research period, the County-wide Urban Area Working Group, working under the auspices of the Unified Disaster Council, decided to purchase two Lenco BearCat armored tactical vehicles to be placed into service in Northern San Diego (Escondido and Oceanside). These two vehicles complemented two other Lenco BearCat armored tactical vehicles which were already in service for the City of San Diego, and the San Diego County Sheriff's Department. This gave the San Diego region armored tactical coverage in all quadrants of the County with the exception of southern San Diego. As Chula Vista had received approval to purchase an armored tactical vehicle via Operation Stonegarden, staff determined that it would be prudent to maintain regional operability by purchasing the Lenco BearCat rather than other brands which are available. This would allow drivers from any of the aforementioned agencies to utilize this vehicle for various operations 1 The cities of Coronado, National City, Chula Vista, Imperial Beach, San Diego, and unincorporated areas of the San Diego County. 9-2 NOVEMBER 23, 2010 Item~ Page 30[5 when needed, and not have to rely on availability ofChula Vista Police Department personnel. This maintains the regional focus of both Homeland Security policies, as well as the County's own strong regional focus. The Lenco BearCat is considered the standard for armored vehicles by both law enforcement, as well as the US State Department, US Department of Homeland Security, US Air Force, US Marine Corps and the US Navy. Since the development of the BearCat in 2000, Lenco Armored Vehicles has produced over 800 BearCats. The Lcnco BearCat has been sold to over 90% of the top 100 urban areas in the United States and is the official SW AT vehicle for 26 State Police agencies, a~ well as Los Angeles Police Department, Los Angeles Sheriffs Department, New York Police Department, San Diego Police Department and San Diego Sheriffs Department, . As was mentioned previously, the Lenco BearCat is the regional choice in San Diego County. In terms of functionality and armor resistance, the Lenco BearCat has been designed to provide exceptional protection and maneuverability, as well as survivability which can not be matched by competitors. In order to get the lowest price available for the Lenco BearCat, the Department was recently approved to utilize the State of California's Public Satety Purchasing Program. This program allows local law enforcement agencies to take advantage of the Federal Governments GSA contract pricing. This allows the Police Department to take advantage of the significant volume pricing discounts that the Federal Government receives. Utilizing the GSA contract for this purchase allows for a nearly 5% reduction in the cost of the vehicle. The fmal purchase price including delivery and sales tax is $297,318.84. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 toot rule found in California Code of Regulations section 1 8704.2(a)(1) is not applicable to this decision. FISCAL IMPACT The City Council accepted Federal grant funds which will fund this purchase on February 9th, 2010. No appropriations are needed. Funds for fuel were included in the original Council action. No General Fund appropriations will be needed for the purchase or maintenance ofthis vehicle. . ONGOING FISCAL IMPACT The Department will utilize non-General Fund funds to maintain the vehicle. WHEREAS, the Police Department was awarded a grant lor $407,974 as part of Operation Stone garden to conduct regional law entorcement operations to intercept terrorists and their weapons from coming across the United States Border; and WHEREAS, as part of this grant award, the Department was awarded funding tor an armored tactical vehicle and the City Council accepted the funds via Council Resolution 20 I 0- 033; and WHEREAS, the Police Department recently became certified to purchase police related equipment through the State of California Public Safety Procurement Program which allows the City to purchase from Federal Governments GSA contracts; and WHEREAS, as Operation Stonegarden is a regional operation, in conjunction with many other law entorcement agencies, and the BearCat was chosen as a regional asset allowing the other agencies in San Diego County to utilize. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does hereby waive the competitive bidding process and authorize. the Police Department to purchase one Lenco BearCat (Armored Tactical Vehicle) via the State of California Public Safety Procurement Program (1122 Counterdrug Program) utilizing GSA Contract GS-07F- 0290M.
