HomeMy WebLinkAboutAgenda Statement 1987/08/04 Item 10• COUNCIL AGENDA STATEMENT Item 10 Meeting Date 8/4/87 ITEM TITLE: Resolution ~~~ ~~ Authorizing the Mayor to sign a Local Cooperative Agreement between the Department of the Army and the City of Chula Vista for the construction of Telegraph Canyon Flood Control Project SUBMITTED BY: Director of Public Works/City Engineer REVIEWED BY: City Manager f+,~ ~,~~~~ (4/5ths Vote: Yes No X ) The Acting Undersecretary of the Army has approved the Telegraph Canyon Project and they have submitted the Local Cooperative Agreement to the local agency for adoption. It is recommended that Council authorize the Mayor to sign the agreement on the City's behalf. RECOMMENDATION: That Council approve the resolution authorizing the Mayor to sign the Local Cooperative Agreement. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. • DISCUSSION: The Local Cooperative Agreement (attached) was delivered to the Director of Public Works/City Engineer on Friday, July 31, 1987. In order to meet time constraints, staff has put the item on the agenda and attached a copy for Council's review. However, staff has not had time to review the agreement in detail and is proposing to have oral comments to the Council at the Tuesday meeting. Project As you know, staff advertised for the construction of the box culvert portion of the project (from about 200 feet easterly of Broadway to the connection at I-5) in May and opened the bids in late June. It was intended for the City to build this portion of the project ahead of the Army's project. Staff had the project on the agenda to award the contract for July 21, 1987, however, on July 17, staff received a phone call from the Corps of Engineers indicating that the proposed LCA providing for the City to build a portion of the project was overturned by one of the offices in Washington. Therefore, the City will not be building any of the project. This has presented a problem in purchasing Oscar Davila's parcel (600 ft. deep parcel on the west side of Broadway). Originally, the contractor was supposed to be out of that parcel by October 15, but that date has had to be pushed • Page 2, Item 10 • Meeting Date-$7-$'j back to December 15. The Assistant City Manager, Director of Public Works, and Assistant City Attorney have been negotiating with Mr. Davila and his attorney to try to revise that agreement. Project Schedule The schedule for the project is as follows: 1. The Corps of Engineers will advertise the project on August 7, provided the Mayor signs and executes the Local Cooperative Agreement prior to that date. 2. Bids will be opened on September 3, with the contract awarded by September 16. Should the City not be able to come to terms on Mr. Davila's property, we will need to condemn it and have a hearing sometime in August. The County has acquired and the City Council has accepted virtually all of the other remaining parcels on the project, with the exception of one parcel which we have initiated condemnation proceedings at the eastern section. Agreement (LCA) • The Corps has indicated that this agreement still may need minor revisions. Therefore, staff is recommending that the Council authorize the Mayor to sign the contract rather than approve the agreement. Although minor changes may be made after the Council meeting, it is not desirable to delay advertising the project by another week.
