RECONIl~NDATION: Place the Ordinance on its First Reading BQARDS/COMMISSIONS RECOMMENDATION: N/A DISCUSSION: In its June, 1987 bulletin, the Fair Political Practices Commission announced new opinion which will require members of Redevelopment Project Area ittees to be subject to local conflict of interest codes. The new opinion Re Rotman (86-001) overrules the earlier Bonfa opinion which held that Project Area Committee members did not have to file disclosure statements or be subject to the conflict of interest rules. There is a certain amount of incongruity between this new opinion and redevelopment law. Redevelopment law encourages an agency to select businessmen in the Redevelopment area to serve on a Project Area Committee in order to get their input on how decisions of the Agency would affect interested parties. Now since the Political Reform Act will apply to these members, interested parties will have to abstain and we will be deprived of that input. The Community Redevelopment Agency Association announced in its June, 1987 newsletter that it is going to attempt to have an urgency bill introduced that would reverse this opinion. Since the FPPC opinion is now is effect and any future legislation to affect it is entirely speculative, it is necessary for us to amend our ordinance to follow the direction of the FPPC. The proposed amendment will include Project Area Committees on the list of designated employees in the City Code. They will now have to file disclosure statements and will be required to abstain from participating in decisions where the decision could have a material effect on their financial interest.
