SUBMITTED BY: Director of Parks & Recreation "m ~{~ (4/5ths Vote: Yes No X ) The present Agreement between the City and the Sweetwater Union High School District was approved by Resolution No. 7810 on July 15, 1975, and the Agreement with the Elementry School District was approved by Resolution No. 7811 on July 15, 1975. Since that time, the costs of operating and staffing swimming pools have risen considerably. An adjustment to the Agreements is needed to cover these increased costs. Therefore it is my; RECONA~E'NDATION That Council approve the proposed Use Agreements and the new Basic Pool Rental rate for the Chula Vista City School District and Sweetwater Union High School District. BOARDS & COMMISSION: N/A DISCUSSION: At the Council Pre-Budget Hearing in January, 1981, the issue of increased operating cost of the City pools was discussed. One of the suggestions made at that time was to evaluate all program cost and to adjust fees whenever possible. The 1975 Agreement with the City School District has a fixed fee of $33,54 pex hour. This fixed fee includes the following services: *l. Basic Pool Rental. $ 8.41 2. 2 Aquatic Aids at $2.40/hour 4.80 3. 5 Instructors at $3.10/hour. 15,30 4. 25o Administrative Overhead. 5.03 $33.54 *Included a lifeguard at $3.10 per hour. The 1975 Agreement with the High School District has a Fixed fee of $8.41 which includes one lifeguard at $3.10 per hour. The only fixed charge in the proposed agreement is for the pool rental. Charges for Life Guards, Aquatic Aids and Instructors will be made for the actual cost of these services at the time the services are used. ui orm A-113 (Rev. 11/79) by the City r.-;^: ,~,~ ~,~ Chula Vi~~a, Cv,i~ ....;ia Dated q _ ~ ~ ~ ~ STAFF SERVICES PROVIDED: The City will provide one (1) lifeguard and five (5) instructors for the School District's Learn to Swim Program. For these services, the School District will reimburse the City the wage rate of personnel assigned. The rate of personnel's hourly wages are set by the City's Salary and Wage Schedule, adopted each year. For any addi- tional personnel requested, the School District will reimburse the City for personnel hourly rate. Locker Room attendants will not be provided unless School District requests such services. POOL MAINTENANCE: The City shall assume all maintenance responsibility for the pool facilities and such costs will be the sole obligation of the City. INDEMNITY CLAUSE: As authorized by Government Code Section 895.x+, District shall save and hold City harmless from any or all. claims or causes of action for death or injury to persons, or damage to property resulting from negligent acts or omissions of District, its agents, and employees in connection with its use of said pool facility. As authorized by Government Code Section 895.x+, City shall save and hold District harmless from any or all claims or causes of action for death or injury to persons, or damage to property resulting from negligent acts or omissions of the City, its agents and employees resulting from or which may arise by reason of any dangerous or defective condition of City property, including the swimming pool facility which is the subject of this agreement, or by reason of a failure to maintain said swimming pool facility in a safe condition. DISTRICT INSURANCE: The District agrees to take out and maintain at its expense public liability insurance with an insurance carrier satisfactory to City to protect against the District's liabilities mentioned in the Indemnity Clause, and for damages on account of bodily injury, including death resulting therefrom, suffered or alleged to be suffered by any person or persons whatsoever resulting directly or indirectly from any act or activities of District or any person acting for District or under District's control or direction, and also to protect against loss from liability for damages to any property of any person caused directly or indirectly by or from acts or activities of any person acting for District. Such insurance shall be maintained in full force and effect during the entire term of this agreement. A copy of said certificate of insurance shall be sent to the office of City. District agrees that this agreement shall terminate, in the option of the City, upon the effective date of the cancellation, termination, or suspension of any or all of the in- surance policies heretofore mentioned, unless before such effective date District has acquired other insurance which, in the determination of the City, adequately replaces the cancelled insurance. CITY INSURANCE: The City agrees to take out and maintain at its expense public liability ~~ -~~ l ~~ -2- Item 9a, 9b Meeting Date 9-8-81 Page 2 A charge of $10.50 is proposed for the hourly rental rate. 'this rate was derived by totaling the yearly pool operating cost for items such as chemicals and utilities and dividing this total by the number of yearly hours the pool~is operated. This rate can be seen as a significant increase over the old pool rental fee of $8.41 when consideration is given to the fact that the old fee included the services of a $3.10 per hour life guard. The new Pool Use Agreement enables the City to recover operating cost for pools and all staff expense incurred during the district's programs. The Parks and Recreation staff has discussed the new fees with the school districts' staff. School staff can foresee no problems in getting approval fran the School Boards.. FISCAL IlKPACT: The new rental Agreements will produce approximately $10,000 in new revenue to help offset pool operating costs. ~,_~o~~y
