• The subject reorganization proposal was approved by LAFCO on July 13, 1981. Pursuant
to the Government Code and LAFCO's resolution, the City Council at their meeting of
- August 4, 1981, adopted Resolution No. 10582 initiating reorganization proceedings and
setting a public hearing for August 25, 1981 to consider the proposed "ADMA/Pepper Tree
Estates Reorganization." The proposal involves annexation of approximately 10 acres of
• land to the City of Chula Vista and detachments from the San Diego County Flood Control
District-Zone 3 and the Bonita-Sunnyside Fire Protection District. The proposal area
is shown on Exhibit A of this report.
r On August 6, 1981, LAFCO received a "request for reconsideration'! for the subject pro-
, posal from adjacent landowners. The Executive Officer of LAFCO has notified the City
that this proposal, pursuant to Government Code Section 56275, will be reconsidered by
the Commission on September 14, 1981.
RECOMMENDATION: That Council
Adopt a resolution approving the ADMA/Pepper Tree Estates Reorganization, conditioned
upon LAFCO's final determination in favor thereof on September 14, 1981.
DISCUSSION
• 1. Section 56275 of the Government Code provides that any interested persons,
` et seq., desiring any addition, deletion, amendment or revision to LAFCO's resolution
making determinations or any term, condition or other provision contained therein, may
-; within 60 days after adoption of the said resolution, file written application thereof
with the executive officer who shall present the same to the Commission at its next
..
meeting. The section further provides that the Commission's determination shall be
> final and conclusive.
2. The abovementioned "request for reconsideration" filed with LAFCO addresses
-± the potential traffic hazards on Jacaranda Drive and Pepper Tree Road from the proposed
,~ Pepper Tree Estates subdivision.
'~ 3. Recent zoning and prezoning action.
• At the meeting of August 4, 1981, Council adopted Ordinance No. 1949, rezoning
l and reprezoning properties between Pepper Tree Road and E1 Rancho Vista from R-1-10
to R-1-15.
4. It is the opinion of the City Attorney and LAFCO staff that Council may now
take action on the proposed reorganization, conditioned upon LAFCO's final determination
on September 14, 1981.
FISCAL IMPACT
The City will receive property tax revenue from the proposal area pursuant to the
Master Property Tax Exchange Agreement currently in effect between the City and the
County of San Diego.

Gentlemen:
As presented to you in our letters of July 7, 1981 and July 28, 1981,
we believe that the subject rezor~iny and construction plans do not
adequately take into account the rights of the current residents on
adjacent property.
The previous owners of the Cook Ranch property granted access rights
to the rear of our property for purposes of personal access, property
maintenance, and water drainage. The new owners of the property
covered by the subject resolution are unwilling to recognize these
access rights or offer adequate solutions to the problem.
We would therefore like to register our written protest to the proposed
redevelopment of the subject property. There are no assurances that
the developer will recognize the time proven rights of others in the
neighborhood and in fact is demonstrating his desire to develop the
property in a manner of highest profitability without regard for those
that have lived in the area for many years.
The land owned by the undersigned landowners is situated at the extreme
South East corner of the subject property and 464 El Rancho Vista
North.

A77MA Company/Pepper Tree Estates and Annexation
Honorable Manor and Council Members:
We wish to ezpress our strong opposition to Resolution Ao. 105 82
initiating reorganization proceeding for the proposed AIlMA Company/
Pepper Tree Estates involving annexation of our property as well as
5 other pareele of private property and a portion of the Pepper Tree
Road right of way. This annexation is opposed for many reasons.
Initially, the annexation proposed by the developer was to inc7..ude
all of the parcels on Jacaranda Drive, currently in the county. When
the developer discovered the mass objection and realized it would
have to come to a vote which would insure failure to his project, he
changed the annexation proposal to include only those he lalew he could
hopefully force in without a vote. This overt, shabby trick results
in piecemeal annexation at best by leaving three houses at the end
of the dead end street in the county. This sort of annexation is not
to benefit the greatest number of people, all of the people whom the
council should be considering, but one single land speculator and
developer.
The proposed annexation and ARIA project is to deprive the rural
qualities of the private property of of the present owners to benefit
one developer. The present Jacaranda Drive residents and indeed
property owners in adjacent Pepper Tree areas, did not wish to be in
a city density. All properties were originally purchased from
Mrs. Cook who was the greatest proponent of the rural life. We all
built or bought in a county density, under strict CCd~R's regulating
lot sizes to minimum 100 fQOt frontages, deep setbacks, trees could
not be cut etc. There are no lots under 1/2 acre. We were all willing
to make substantial sacrifices to enjoy the raral life and open
spaces. To allow 14 dwellings on 5+ acres (that is all there will ben
after roads are subtracted) is making a mockery of good planning and is not
in keeping with present development. Further, w~.th the great number of
homes now for sale in that area of Chula Vista there appears to be
no pressing need for an additional 14 houses. In fact 2 of the 6 parcels
included in the annexation proposal have been Por sale for a year or more.
Vexing parking problems will be created on Jacaranda Drive by
this annexation and acceptance of the ARIA project. The planning

commission seems to think that they have done us a favor by taking '
away our street parking and giving back 6 parking spaces. We assure
you that this benefits only the developer and not even the potential
future purchasers of his properties.
A glaring insufficiency throughout all proceedings has been failure
t~ address the adverse impact of 140 additional vehicular trips over
what is now private property, a permanent easement, Jacaranda Drive.
A further very real issue of traffic is the ingress and egress of
200 trips (140 new plus the present from Jacaranda Drive to Pepper
Tree SAFELY, Speed is a safety factor on the S Curve, but safe ingress
and egress is the issue where 140 additional trips are being proposed
at the most dangerous section of the road. While it is implied that
Chula Vista police could control thi.a stretch of road, the reality
is that they w1.11 not. The annexation of this area only increases
the area that the existing police have to patrol at a time when response
times are getting longer.
By allowing placement of the roadway, Cook Ct. as proposed, not
only. is the council permitting destruction of most of the large old
trees on the ADMA property, but i$ is creating an undesirable situation
for us as property owners across the street. The auto lights of vehicles
turning into and coming down from Cook Ct. will shine right into our
bedrooms. During recent dlscusslon of this point at a City Council
meeting there was nothing short of levity as the mitigation propa~~d
for this problem was that we should put up a xall or hedges in front
of our windows. It is this kind of reasoning and statement which
makes us believe that the council cares little about the impact this
pro3ect has on existing residents.
It is interesting to us that Mr. Moody representing the Bonita-
Sunnyside Fire Protection District stated opposition to this annexation
and project, in person at the Iu4FC0 meeting. Our impression from the
put down was that their viewpoint was rendered invalid beeause it was
not in writing. The Fire Protection Agency has very valid reasons
for its opposition. Has the Council sought to learn the reasons why?
Does failure to write the Agency's objections cause the very real
problems to vanish?
In the copy of Resolution Ro. 10582 we question the third WHPREAS
paragraph and ask for clarification. The Council did not adopt prezoning
for 10,000 sq, ft. minimua lot size.
To reiterate we are opposed to this proposed project and annexation.
WE have nothing to gain from annexation except increased taxes, increased
crime potential, increased noise pollution, increased air pollution,
annoying lights in our bedroom windows, a greatly increased traffic

hazard at the intersection of Pepper Tree and Jacaranda, a 3006 increase
in traffic on Jacaranda Drive in front of our property, loss of all of
our Wildlife, drainage problems and many other undesirable effects
which the property owners in that area of Chula Vista have pointed out
to the city in the past. ADMA has every right to develop his property
which he purchased as county property, to develop same according to
county specifications with septic tanks and all the other raral ammenities.
We do not believe he has the right to force annexation upon us simply
to increase his profits. If there are twelve registered voters involved
do we not have the opportunity to vote?
We believe that in this matter a vote by the council for annexation
is gross failure of the council to equally and fairly represent all of
the people. A vote for annezation is nothing m®re-than another display
of the council's leanings toward the developer to benefit only that
developer at the expense of every one else, to hear only one voice
when many are askin to be heard. Last fall when we met with Mr. Adler
he informed us with witnesses present) that he "had enough money to
fight us forever, but that he was going to develop this dust like he
wants it." Does that say that money means power, means overpowering,
means getting one's way at any ezpense? If t~Y3 is an indication of
how Mr. Adler operates, we think that if we were elected officials
we might have some second thoughts about supporting this land speculator
so wholeheartedly.
We urge ,your votes against reorganization and annexation.
