HomeMy WebLinkAboutAgenda Statement 1981/08/04 Item 7COUNCIL AGENDA STATEMENT Item .7 Meeting Date 8/4/81 ITEM TITLE: Resolution ~~~.'~ Initiating reorganization proceedings for the proposed ADMA Co./Pepper Tree Estates Reorganization SUBMITTED BY: Director of Planning ' (4/5ths Vote: Yes Nom) On April 6, 1981 Mr. Nathan Adler, president of ADMA Co., Inc., submitted to the City a petition fora reorganization involving annexation of approximately 10 acres of land to the City and detachments from the San Diego County Flood Control District-Zone 3 and the Bonita-Sunnyside Fire Protection District. This is an inhabited proposal (more than 12 registered voters residing within the proposal area) and all but one of the involved property owners have consented to annexing to the City of Chula Vista. The fact that the annexation is inhabited with less than 100% concurrence to the annexation requires that the item be set for public hearing. The proposal area is shown on Exhibit A of this report. RECOMMENDATION: That Council: Adopt a resolution initiating reorganization proceedings and setting a public hearing for August 25, 1981 to consider the proposed "ADMA Co./Pepper Tree Estates Reorganization" involving annexation to the City of Chula Vista and detachments from the San Diego County Flood Control District-Zone 3 and the Bonita-Sunnyside Fire Protection District. DISCUSSION 1. The lands in question are located in the southeasterly quadrant of the intersection of Pepper Tree Road and Hilltop Drive in the unincorporated territory of San Diego County. The proponent is requesting annexation to the City in order to obtain an increased level of municipal services over that which is currently provided in the County of San Diego. 2. The proposal area consists of six parcels of private property and a portion of the Pepper Tree Road right of way. The annexation proponent, also owner of the 7.29 acre parcel, intends to subdivide said parcel into 14 lots to facilitate the development of 13 new single family dwellings and accommodate an existing estate dwelling. On June 9, 1981 the City Council approved the tentative subdivision map for this project. 3. Environmental Review. The City Council, at the meeting of June 9, 1981, adopted resolutions approving the environmental impact report for this project (EIR-81-2) and associated CEQA findings. 4. Prezoning action. At the time of application for annexation, the existing prezoning was R-1-10 (10,000 sq. ft. minimum lot size), adopted by Council on October 5, 1971, Ordinance No. 1363. Following consideration of the tentative map on June 9th, Council referred the matter of zoning back to staff and asked staff to evaluate a city initiated rezoning/re-prezoning classification of R-1-15. The Planning Commission considered and approved the proposed rezoning/re-prezoning on July 8, 1981. On July 28, Council introduced an ordinance prezoning the area to R-1-15. continued Form A-113 (Rev. 11/79) Page 2, Item 7 Meeting Date 8/4/81 5. LAFCO action. The Local Agency Formation Commission conducted a public hearing for this proposal at their meeting of July 13, 1981 and adopted a resolution approving said proposal. Pursuant to Government Code Section 56271.1 and in accordance with LAFCO's resolution, the City of Chula Vista has been authorized to initiate: reorganization proceedings in compliance with Government Code Section 56430 et seq. and LAFCO's resolution. 6. Initiation of reorganization proceedings. Reorganization proceedings consist of two Council actions, which are: (a) Adopting a resolution initiating reorganization proceedings and setting the time and date for a noticed public hearing for the purpose of considering the proposed reorganization; and (b) conducting a public hearing at the time and date as specified, considering the proposal, and taking appropriate action in compliance with the Government Code. In accordance with Government Code Section 56430(e) the City Council may, at the earliest, conduct said public hearing at the regularly scheduled meeting of August 25, 1981. 7. Municipal Services delivery. The City's Police, Fire, and Public Works Departments have determined that the proposed annexation and subsequent development of 13 single family dwellings will not require additional manpower and/or equipment. FISCAL IMPACT The City will receive property tax revenue from the proposal area based on the P-faster Property Tax Exchange Agreement .currently in effect between the City of Chula Vista and the County of San Diego.
