The contract dated January 21, 1981, expired June 5, 1981. Due to conflicting wording in the contract documents in relation to "end of im provement contract" and "end of maintenance period," we are requesting Council to take the following action. It is m y RECOMMENDATION: That Council accept the public improvements, authorize full paymentfor work performed to date, with the retention of $10,280.00 for lawn maintenance and extend the contract time to September 28, 1981. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: Under the original conditions of the contract the improvements would be completed in sixty working days and then a maintenance period would begin which would last for 120 calendar days. The contractor would have received his full payment except for 10$ retention at the com pletion of the contract and the remaining i0~ in 30 days. The money for the maintenance period would be paid for at the end of the 120 day period if the work was acceptable to the City. The amount of the item for the maintenance period was $10,280.00. On June 1, 1981, the contractor had com pleted all of the work except for the following items: 1. the installation of three backstops; 2. replacement of some A.C. pavement and removal of the temporary construction fence. The fence was to remain around the entire project during the construction period but, in addition, the Landscape Architect has required that the fence remain during the maintenance period to keep people and animals off of the lawn. Because that fence is there and the lawn is beginning to grow, the contractor was not able to install the three backstops and was unable to replace a small portion of the asphalt pavement. 1 Form A-113 (Rev. 11,/79) Pag a 2, Item 14 Meeting Date 7--14--81 ~, Upon proper establishment of the lawn after the maintenance period and removal of the construction fencing, the contractor will replace the three backstops and will complete the paving work in the area of the fence. I believe it is not appropriate nor necessary to hold the normal 10~ retention ($11,789) plus $10,280.00 for a lawn maintenance period of 120 days after the work was com pleted. On the other hand, the work shouldn't be accepted until the work is finished in September. Therefore, I believe the contractor should be paid for work com pleted to date and that $10,280.00 be retained for lawn maintenance and a guarantee of the remaining items of work (placement of three backstops and eight tons of AC paving). This has been agreed to by the contractor and will be performed upon the acceptance of the lawn maintenance by our City Landscape Architect. Based upon the discussion above, I recommend that the Council: 1. accept the public im provements com pleted to date; 2. approv e full payment of the work com pleted to date; 3. extend the contract completion time to September 28, 1981, with n o penalty to t he contractor. Slides are available for Council viewing. FINANCIAL STATEMENT: This project was constructed with Block Grant Funds. Amount of Authorized Ex penditure $125,300.00 Original Contract Amount 113,915.10 Construction Cost, including lawn 117,893.73 maintenance Balance $ 7,406.27 The difference in contract cost and construction cost is due to the final field measurements of concrete work and labor costs to pay prevailing wages as required by contract and HUD. The balance will be used to pay construction engineering and administration costs. Any remaining amount will be transferred to block grant local option. FISCAL IMPACT: Chula Vista City School District will assume maintenance upon acceptance of work. DMH:nr/JO--008 -~ D ~S~ 2
