HomeMy WebLinkAboutAgenda Statement 1981/07/14 Item 8COUNCIL AGENDA STATEMENT Item .8 Meeting Date 7/14/81 ITEM TITLE: Resolution~QS~~ Adopting regulations for candidates for the Mayor's Office pertaining to materials submitted to the electorate and costs thereof for the November 3, 1981 Consolidated General Election SUBMITTED BY: City Clerk (4/5ths Vote: Yes No x ) In accordance with the Federal Voting Rights Act of 1965 (amended 1975), the City Clerk is charged with providing a Spanish translation of the Candidate's Statement to those candidates who wish to have one - this charge is borne by the City and not the candidate. In accordance with the provisions of the Elections Code, it is my RECOMMENDATION: that the City Council approve the resolution which defines the cost of the Candidates' Statements and further, does not allow candidates the option of sending out their campaign material with the sample ballots. DISCUSSION: For the November 3, 1981 election, the Registrar of Voters office will be sending out 255 different ballots. In view of this complex multiplicity of ballots, they have determined that no separate campaign materials can be permitted. The Registrar of Voters is now sending out a separate Spanish sample ballot package to a list of those people who have requested same. The Spanish translation of the Candidate' Statements for the office of Mayor will be included in this booklet. Section 10012 of the State Elections Code now permits a local agency to estimate the total cost of printing, handling, translating and mailing of the Candidates' Statements and require the candidate to pay in advance his or her pro rata share as a condition of having the statement included in the voter's pamphlet. Collecting this money in the past has not been th at much of a problem and it would be my recommendation not to charge the candidate,, in advance but to continue billing them on an actual prorated cost of the printing and handling of these Statements as soon as the invoice is received from the printer.
